In this phrasing, the award of the success fee still remains contingent on actual success. It simply means that a success fee has been set aside as added incentive.

In law, "prevedere" means "provide for", which is why in this context one would/could translate "previsione" as "provision".

There are two separate sums: the hypothetical intermediary expert would receive a set minimum in compensation regardless of the outcome of the sale, plus a success fee should the outcome of the sale be favorable.

It doesn't sound absolutely definite that this additional fee is going to be forthcoming, so something slighly non-commital in English may be prudent.

agree Mr Murray (X) : even though 'la previsione di' literally leaves some room for ambiguity, the whole sentence does not appear to be a conditional - no 'if' or 'when', but more absolute. Anytime I find it in this context, I'd conclude 'it will be applied' [even if it's €0]
