I tempi che lo Stato ha previsto per accertare la responsabilità dell'imputato sono notevolmente lunghi e se la magistratura non riesce a giungere ad una sentenza definitiva in tali tempi tale responsabilità è addebitabile solo alla Pubblica Accusa poiché l'imputato non sarebbe mai in grado di dilatare i tempi processuali senza vedersi sospendere i tempi di prescrizione.
