"XXX è consapevole che l’inosservanza di tale obbligo costituisce grave inadempimento contrattuale ai sensi dell’art. 1455 cod. civ. e legittima YYY a risolvere il contratto in essere, ai sensi dell’art. 1456 cod. civ., ***fermo restando*** il risarcimento dei danni e ***la tutela dei diritti da esercitarsi nelle sedi competenti***."

As you can see, this follows on from my previous query. "Without prejudice to the safeguarding" seems like a tautology, would "without prejudice to the exercise of its rights" (in the appropriate fora) be appropriate here?

I think you've confused things slightly by effectively asking the same question twice. But as with the previous one, "fermo restando" means not just "without prejudice to", but "without prejudice to its right to".

nelle sedi competenti... at the AmE: *proper* (legal) venues OR: enforceable BrE in the courts of competent jurisdiction.

The first weblink suggests 'la tutela' is the enforcement, though seems to contradict 'esercitarsi'.
