This is part of clinical trial protocol explaining the kind of insurance the sponsor will be taking out to cover patients taking part in the trial.
"Le promoteur souscrit pour toute la durée de l’étude, une assurance garantissant sa responsabilité civile ainsi que la responsabilité de tous les investigateurs impliqués dans la réalisation de l’étude. Il assurera également l’indemnisation intégrale des conséquences dommageables à la recherche pour la personne qui s’y prête, sauf preuve à la charge que le dommage n’est imputable à leur faute, sans toutefois que puisse être opposé le fait d’un tiers ou le retrait volontaire de la personne qui avait initialement consenti à se prêter la recherche (loi n° 88-1138, Art. L.209-7)."

And I would say that the "ne" is like "à moins qu'il n'ait..." if you see what I mean ?! Also it seems logical from the sense I think.

except if it can be proved that the damages suffered can be attributed to the trial participants (themselves).

OK. After reading the Article...
...except if the damages can be proved not to be the result of any negligence or fault on the part of the Promoter.

What do you think about that? You could also add "...proved (and the onus will be on the Promoter to provide relevant evidence to support this) not to be etc..."

Asker: Hi Juliette, when you say it seems logical, to me your translatrion reads that the sponsor will compensate patients who suffer harm in the trial unless it can be proved that the sponsor/investigators are responsible for the harm i.e. if they're responsible the patient gets no compensation. I must be missing something as both answers concur. Can you explain?
