agree Adrian MM. (X) : join in as a third party. Impleader is US and a rare E&W crim. process. Also indemnfication is right & not strictly a guarantee: in E&W - the defendant joins a third-party for a 'contribution & indemnity' . Previous kudoz answers have been misguided.

True and I agree about E&W. Legalese is confusing to most non-lawyers as you have to look at the concept over the literal translation. I have over 20yrs experience as a trial lawyer in civil and criminal litigation in the US, some terms still confound me

Typically, xxxx would be an insurer.

neutral Adrian MM. (X) : Guarantee is a false friend. In Arg., a comparable process allows a victim to claim directly on an offending motorist's ins. pol. Even then, the ins. corp. is an indemnifier and not a guarantor.
