any of these would do "di merit" means a case on wich judge is handed down based on the legal merits applied to the facts of the case ... at least this is what the text book says in Italy ...

: If you need to distinguish this from the other terms that follow, this refers to the original trial case in the lower court. Plus (I can't seem to add this any other way), yes, this would be the trial on the merits and not on procedural issues.

Thanks Sylvia. On the basis of the distinction made by dariodipi between "di merito" & "di legittimità", I would say it's the difference between a trial on the merits/facts and "proceedings on a point of law"
