I think this is one of many "real obligations". As wiki explains it is an obligation which goes with the property when it changes ownership, like paying for communal facilities in a condominium. A mortgage is a real obligation, but it is a pledge and encumbrance a different thing. It prevents a normal transfer of ownership.

I get there through French...in which an obligation PROPTER REM is also called a REAL OBLIGATION. It is referred to properties, real estate properties.

ancillary covenants running with the land; collateral obligations

As this is to do with land, I believe covenants is the right word in E&W, plus collateral warranties in the E&W law of contract - to get round the doctrine of privity of contract - is incongruous.
