Le règlement 1408/71 prévoit des techniques de coordination des législations nationales pour permettre aux travailleurs migrants d’exercer leur droit de libre circulation sans perdre le bénéfice du droit aux prestations sociales qu’ils tiennent de différentes législations successives. Ces techniques ont pour effet de déroger à la logique territoriale des Etats Membres, source d’inégalité et d’entrave à la mobilité intra-communautaire. Deux dimensions sont prises en compte pour l’élaboration et l’application des règles de coordination. La dimension spatiale se manifeste par la règle de la détermination de la loi applicable. La dimension temporelle se manifeste par des mécanismes de conservation des droits acquis ou en cours d’acquisition.
L’APPLICATION DE LA « LEX LOCI LABORIS »
Les règles communautaires de rattachement sont l’expression d’un choix entre deux conceptions de la sécurité sociale. La conception « bismarckienne » propose une vision de la sécurité sociale fondée sur des rapports de travail. Répondant à une logique d’assurance, les prestation versées le sont en contrepartie de l’exercice d’un travail. Les coûts de la sécurité sociale sont à la charge de l’Etat où le travailleur exerce son activité et contribue à ce régime.
Pour les rédacteurs du règlement 1408/71, le choix du facteur de rattachement s’inscrit dans le cadre de la libre circulation des travailleurs, envisagée à l’origine dans sa dimension économique. Par conséquent, la loi de l’Etat d’emploi ou du lieu d’exercice de l’activité économique est apparue comme la référence principale pour déterminer la législation applicable. La conception bismarckienne est alors adoptée pour l’ensemble de la protection sociale, qu’elle soit contributive, c’est-à-dire sur une logique d’assurance, ou non contributive, c’est-à-dire répondant à une logique d’assistance. L’absence di distinction entre les deux conceptions risque d’engendrer une inadaptation du principe à certaines catégories de travailleurs ou de prestations. Mais le règlement 1408/71 a le mérite de poser des règles uniformes pour tous les travailleurs migrants, ainsi qu'une multitude de règles particulières adaptée à la situation particulière de certains assurés. Ce principe de la primauté de la « lex loci laboris » a été précisé et renforcé par la Cour de Justice selon la quelle le défaut de disposition spécifique pour une situation juridique donnée entraîne l’application de la loi de l’Etat d’emploi.

Il regolamento 1408/71 prevede delle tecniche di coordinamento delle legislazioni nazionali per consentire ai lavoratori migranti di esercitare il loro diritto di libera circolazione senza perdere il beneficio del diritto alle prestazioni sociali di cui godono in forza di diverse legislazioni successive. Queste tecniche hanno per effetto di prescindere dalla logica territoriale degli Stati membri, fonte di disparità e di ostacolo alla mobilità intracomunitaria. Al fine di elaborare ed applicare le norme di coordinamento, sono prese in considerazione due dimensioni. La dimensione spaziale si manifesta mediante la norma della determinazione della legge applicabile . La dimensione temporale si manifesta mediante meccanismi di conservazione dei diritti acquisiti o in corso di acquisizione.
L'APPLICAZIONE DELLA "LEX LOCI LABORIS"
Le norme comunitarie di collegamento sono l’espressione di una scelta fra due concetti di sicurezza sociale. Il concetto “bismarckiano” propone una visione della sicurezza sociale fondata sui rapporti di lavoro. Rispondendo ad una logica assicurativa, il versamento delle prestazioni avviene come contropartita all’esercizio di un lavoro. I costi della sicurezza sociale sono a carico dello Stato in cui il lavoratore esercita la propria attività e contribuisce a questo regime.
Per i redattori del regolamento 1408/71, la scelta del fattore di collegamento si iscrive nel quadro della libera circolazione dei lavoratori, prevista originariamente nella sua dimensione economica. Di conseguenza, la legge dello Stato di impiego o del luogo di esercizio dell’attività economica è apparsa come il riferimento principale al fine di determinare la legislazione applicabile. Il concetto bismarckiano è allora adottato per la protezione sociale nella sua globalità, sia essa contributiva, ossia fondata su una logica assicurativa, o non contributiva, ossia rispondente ad una logica assistenziale. L’assenza di distinzione fra i due concetti rischia di generare una inadattabilità del principio a talune categorie di lavoratori o di prestazioni. Ma il regolamento 1408/71 ha il merito di stabilire regole uniformi per tutti i lavoratori migranti, nonché una moltitudine di norme particolari adeguate alla situazione specifica di taluni assicurati. Questo principio della supremazia della "lex loci laboris" è stato precisato e rafforzato dalla Corte di Giustizia secondo cui la mancanza di una disposizione specifica per una data situazione giuridica comporta l’applicazione della legge dello Stato di impiego.

Testo originale - Inglese The rules governing the taking of security (in the form of a pledge) over units of an Italian investment fund have to be found, basically, in Legislative Decree 21.5.2004, n. 170, with which it has been implemented in Italy the Financial Collateral Directive (Directive 2002/47/CE). Pursuant to the scope of the Directive, the Decree sets out the formalities and regulates the contents and effects of the agreement through the creation of a security over “financial instruments” and “credits”.
As we will see, the qualification of units or shares of an Italian fund is still a matter of discussion but, notwithstanding the fact that they could be considered either as financial instruments or as credits, in either case they would fall under the scope of the Decree.
REGULAR PLEDGE
If the fund units to be secured are – as should be expected – held in the global certificate, managed by the Custodian bank on the basis of the system which has been briefly described above, the creation of a valid and enforceable pledge shall, first of all require, an agreement in writing (pledge agreement) which identifies the object of the pledge, the object of the credit which is being secured, and all other rights and obligations of the parties. If the pledge is qualified by the parties as a regular pledge, the ownership of the fund’s units shall remain with the pledgor, while the pledge shall have the power to retain the fund’s units, which shall be under the control of the pledge until the pledge agreement is effective.
After the implementation of the Collateral Directive by Legislative Decree n. 170/2004, and due to the circumstance that the pledgor is represented by an Italian Investment Management Company (“SGR”) the agreement with which a regular pledge is executed can, amongst other, include:
- provisions which allow for the appropriation of the pledge to the pledgee in case of enforcement (art. 3 of the Decree);
- provisions which regulate the formalities to be carried out in case of enforcement of the pledge (art. 4 of the Decree);
- provisions which allow the pledgee to use the financial instruments which are pledged (art. 5 of the Decree);
- provisions which regulate the substitution of the pledge, and the provision of additional collateral (art. 9 of the Decree).
Traduzione - Italiano Le norme che disciplinano l’assunzione di garanzie (in forma di pegno) sulle unità di un fondo comune di investimento Italiano sono da reperire fondamentalmente nel Decreto Legislativo 21.5.2004, n. 170, con il quale è stata resa effettiva in Italia la Direttiva in materia di Garanzia Finanziaria (Direttiva 2002/47/CE). In relazione al campo di applicazione della Direttiva, il Decreto stabilisce le formalità e disciplina i contenuti e gli effetti del contratto attraverso la creazione di una garanzia su “strumenti finanziari” e “crediti”.
Come esamineremo, la qualifica di unità o azioni di un fondo Italiano è tuttora materia di discussione ma, a prescindere dal fatto che possano essere considerate come strumenti finanziari o come crediti, esse rientrano comunque nell’ambito di applicazione del Decreto.
PEGNO REGOLARE
Qualora le unità del fondo da garantire fossero detenute – come prevedibile – nel certificato globale e gestite dalla banca depositaria secondo il sistema qui sopra brevemente descritto, la costituzione di un pegno valido ed efficace richiederà innanzitutto un contratto per iscritto (contratto di pegno) che identifichi l’oggetto del pegno, l’oggetto del credito da garantire nonché tutti i diritti e le obbligazioni delle parti. Qualora il pegno fosse qualificato dalle parti come pegno regolare, la proprietà delle unità del fondo rimarrà al debitore pignoratizio, mentre il creditore pignoratizio avrà il potere di trattenere le unità del fondo, che rimarranno sotto il controllo del creditore pignoratizio fino all’entrata in vigore del contratto di pegno.
Dopo l’attuazione della Direttiva in materia di Garanzia Finanziaria per mezzo del Decreto Legislativo n. 170/2004, e a seguito della circostanza per cui il debitore pignoratizio è rappresentato da una Società di Gestione del Risparmio Italiana (“SGR”) il contratto con il quale viene eseguito un pegno regolare comprende fra l’altro:
- le disposizioni che consentono l’appropriazione del pegno da parte del creditore pignoratizio in caso di escussione (art. 3 del Decreto);
- le disposizioni che disciplinano le formalità da compiere in caso di escussione del pegno (art. 4 del Decreto);
- le disposizioni che consentono al creditore pignoratizio di disporre degli strumenti finanziari oggetto del pegno (art. 5 del Decreto);
- le disposizioni che regolano la sostituzione del pegno e la clausola relativa a garanzie finanziarie addizionali (art. 9 del Decreto).

(A) Nature of a legal mortgage
(i) A legal mortgage over registered shares is characterised by a transfer of legal title to the security holder or its nominee (the "Mortgagee") with an express or implied right for the retransfer of legal title to the secured shares back to the security granter (the "Mortgagor") upon satisfaction of the secured obligations. This right of the Mortgagor is known as the "equitable right of redemption". The Mortgagee obtains legal title to the shares by relevant entry in the company's register of members by the company or the company's registered agent.
(ii) A legal mortgage is the most comprehensive and secure form of security over registered shares. The legal mortgage is not reliant on the Mortgagor or the company or the company's registered agent taking any action in order for the Mortgagee to enforce or realise the security.
(iii) As regards priority, a legal mortgage cannot be defeated by a later in time legal mortgage.
(b) Enforcement of a legal mortgage upon Mortgagor default:
(i) The Mortgagee will usually have a power to appoint a receiver under the terms of a legal mortgage. A usual clause would be that a Mortgagee is entitled to appoint a receiver if he reasonably believes that the security is in jeopardy.
(ii) The Mortgagee will be able to sell the shares to a third party (not to itself) in reduction or satisfaction of the debt outstanding. The power of sale will arise under the terms of the contract.
(iii) The third remedy, foreclosure, is a cumbersome enforcement measure and is very rarely used nowadays because the power of sale is thought to be as effective. Foreclosure is only available on application to the court. An order for foreclosure abrogates the Mortgagor’s equitable right of redemption and leaves the entire value of the mortgaged property in the hands of the Mortgagee. The court is entitled to sell in lieu of foreclosure.
(iv) A legal mortgagee has an immediate right to possession. This right is regardless of default unless there is an express or implied exclusion under the terms of the mortgage that the Mortgagee will only take possession on default. A Mortgagee can also take possession before the legal redemption date for the mortgage has passed.

(iii) Per quanto attiene alla priorità, un’ipoteca legale non può essere annullata da un’ipoteca legale iscritta in data successiva.
(B) Escussione di un’ipoteca legale per inadempienza del Debitore Ipotecario:
(i) Il Creditore Ipotecario avrà solitamente il diritto di nominare un liquidatore ai sensi delle disposizioni di un’ipoteca legale. Una clausola che è normalmente adottata potrebbe riguardare il diritto del Creditore Ipotecario alla nomina di un liquidatore qualora costui possa ragionevolmente ritenere che la garanzia sia a rischio.
(ii) Il Creditore Ipotecario potrà vendere le azioni a un terzo (non a se stesso) a titolo di riduzione o estinzione del debito insoluto. Il diritto di vendita risulterà dai termini del contratto.
(iii) Il terzo rimedio, il pignoramento, è una misura esecutiva gravosa adottata oggigiorno molto di rado in quanto il potere di vendita è ritenuto altrettanto efficace. Per procedere al pignoramento è necessario adire un tribunale. Un’ordinanza di pignoramento abroga il diritto di riscatto per avvenuto pagamento dell’ipoteca da parte del Debitore Ipotecario e lascia l’intero valore della proprietà ipotecata nelle mani del Creditore Ipotecario. Il Tribunale ha il diritto di procedere alla vendita piuttosto che al pignoramento.
(iv) Un’ipoteca legale implica un diritto di possesso immediato. Il diritto esiste a prescindere dall’inadempienza salvo che le condizioni dell’ipoteca non escludano espressamente o implicitamente che il Creditore Ipotecario acquisisca il possesso in caso di inadempienza. Un Creditore Ipotecario può altresì acquisire il possesso prima dell’intercorsa data di svincolo legale dall’ipoteca.

When annual company objectives are communicated, each Director / Manager formulates and aligns their own department / team targets. In a meeting between the employee and the supervisor, at the beginning of the performance period, the following should be determined:

- Key Responsibilities:
Key responsibilities describe the results the employee has to produce in order to order to achieve the job mission. Key responsibilities are in general and describe the activities to be performed by the employee.
The supervisor and employee can use the job description and prioritised with a maximum of 7. Key responsibilities belong to the function; therefore modifications are exceptional and are a result of changing priorities.
Examples:
• Disseminate and escalate communication to keep team and management informed
• Conduct regular Performance Review to improve team member’s performance
• Schedule work to achieved allocated objectives
- Expected Results:
Performance Indicators:
Expected results in terms of specific standards and goals should be established by using measurable or at least observable, achievable, realistic and time bound performance indicators.
Measurable:
To make objectives measurable, assign to them or determine another way to clearly state what you must do. Avoid reference to subjective statements such as “attitude” and “initiative” that cannot be objectively documented.
The measurement is always on quality, quantity, cost or timeline.
Examples:
Quality: The measurement: Percentage of client surveys in the ‘good’ to ‘excellent’ range
Quantity: As measurable objective: Score in the good to excellent range on 90% of customer survey responses.
Achievable:
Objectives should always be challenging, yet reasonable and achievable. They should be aggressive: objectives set too low will offer little challenge, objective set too high are frustrating.
Realistic:
Objectives must be set in the areas the employee can influence
Time bound:
Objectives need to tell you what to do as well as when to do it so it should include timeframes.
Example: Stay within 10% of budget per project.
Standards: Maintaining a given level of performance.
Example: “Maintain no more than 5% overall variance for operating budget”.
Goals: Moving of performance from one level to another level.
Example: “Reduce scrap rate of $ 5,000 per month 10% by June 1st.
Advantage of measuring the performance:
• The employee can manage his own performance when the measurement shows that the employee is meeting the objective.

SCOPO
Il futuro sostenibile di questa azienda dipende dal contributo attivo di ogni membro del personale al conseguimento degli obiettivi aziendali. Scopo del sistema di gestione delle performance è quello di offrire gli strumenti e le linee guida di supporto al singolo dipendente, alla singola divisione e all’azienda nel suo complesso per il raggiungimento di tali traguardi.
AMBITO DI APPLICAZIONE
La nostra gestione delle performance ovvero la PPRD prevede riunioni che hanno come oggetto degli “accordi di performance”, nonché sessioni di riesame che si tengono lungo tutto l’arco dell’anno con ogni singolo dipendente, intese a fornirgli l’assistenza necessaria alla realizzazione degli obiettivi previsti. Il PPRD è un processo in via di sviluppo che comporta l’individuazione degli obiettivi a intervalli regolari, la comunicazione, il follow up, la valutazione e l’attribuzione di ricompense.
Nel momento in cui vengono comunicati gli obiettivi aziendali, ogni Dirigente / Responsabile formula e allinea i target per la propria divisione o per il proprio team.
I dipendenti sono quindi tenuti a definire e a concordare con il loro rispettivo Responsabile i propri obiettivi personali. Ciò garantirà che le attività del singolo siano direttamente di supporto agli obiettivi globali dell’azienda.
Il nostro processo contribuisce a dirigere gli sforzi delle risorse o a far fronte di volta in volta alle esigenze del business in costante evoluzione. Un dipendente può lavorare alacremente, ma lavorare sulle cose sbagliate.

1. PIANIFICAZIONE DELLE PERFORMANCE
Nel corso di una riunione fra il dipendente e il supervisore da tenersi all’inizio del periodo di performance, è necessario determinare quanto segue:

- Livello di Autorità di ogni Responsabilità Chiave
- Responsabilità Chiave:
Le Responsabilità Chiave individuano i risultati che i dipendenti devono conseguire al fine di realizzare la missione del job. Le responsabilità chiave sono di natura generale e descrivono le attività che il dipendente deve svolgere.
Il supervisore e il dipendente possono avvalersi della descrizione del job e stabilire delle priorità in un numero massimo di 7. Le responsabilità chiave appartengono alla funzione; le eventuali modifiche hanno quindi un carattere eccezionale e sono il risultato di un cambiamento delle priorità.
Esempi:
• Diffondere la comunicazione e informare i vertici aziendali (escalation) per mantenere la continuità di feed-back fra team e management
• Condurre in via regolare il Riesame delle Performance al fine di migliorare le prestazioni del membro del team
• Programmare il lavoro per il conseguimento degli obiettivi assegnati

Indicatori di Performance:
L’aspettativa nei confronti dei risultati in termini di standard e traguardi specifici deve basarsi su indicatori di performance misurabili o per lo meno osservabili, conseguibili, realistici e vincolati ad un determinato periodo di tempo.
Misurabili:
Al fine di rendere gli obiettivi misurabili, è necessario assegnarli ovvero determinare un modo alternativo affinché venga chiaramente stabilito cosa si deve fare. Evitare riferimenti ad affermazioni di tipo soggettivo quali “attitudine” e “iniziativa” che non possono essere oggettivamente documentate.
La misurazione verte sempre sulla qualità, la quantità, il costo o la sequenza cronologica (time line).
Esempi:
Qualità: La misurazione: Percentuale di indagini sulla clientela nella fascia da “buono” a “eccellente”
Quantità: Come obiettivo misurabile: Ottenere la fascia da buono a eccellente sul 90% delle risposte di indagini sulla clientela.
Conseguibili:
Gli obiettivi devono sempre essere stimolanti, seppur ragionevoli e ottenibili. Devono essere aggressivi: obiettivi facilmente raggiungibili implicano una sfida poco interessante, obiettivi difficilmente raggiungibili rendono la sfida frustrante.
Realistici:
Gli obiettivi devono essere stabiliti nelle aree di influenza del dipendente
Vincoli temporali:
Gli obiettivi devono stabilire cosa fare ma anche quando agire, e devono quindi contemplare dei limiti temporali.
Esempio: Rimanere entro il 10% del budget di ciascun progetto
Standard: Mantenimento di un dato livello di performance.
Esempio: “Mantenere uno scostamento dal budget operativo non superiore al 5%”.
Traguardi: Spostamento della performance da un livello ad un altro livello.
Esempio: “Ridurre il tasso di scarto di $ 5.000 mensili del 10% entro il 1° Giugno”.
Vantaggi della misurazione delle performance:
• Il dipendente può gestire la propria performance qualora la misurazione evidenzi che il dipendente ottempera all’obiettivo.
• È possibile affrontare i problemi prima che divengano ingestibili
• Fornisce le informazioni da utilizzare per il riesame della performance

(1) THE LONDON ORGANISING COMMITTEE OF THE OLYMPIC GAMES AND PARALYMPIC GAMES LIMITED a company incorporated in England and Wales with company number 5267819 whose registered office is at One Churchill Place, Canary Wharf, London E14 5LN (“LOCOG”); and
(2) XXX a company incorporated in Italy with company number [ ] whose registered office is at XXX, Italy (the “Supporter”).

DEFINITIONS AND INTERPRETATION
Definitions: In this Agreement, the following terms and expressions shall have the following meanings:

“IOC” means the International Olympic Committee of Chateau de Vidy, 1007 Lausanne, Switzerland;

“ODA” means the Olympic Delivery Authority, a public body established by the London Olympic Games and Paralympic Games Act 2006, being the body which is responsible for delivering the permanent infrastructure for the 2012 Games;
“Olympic Charter” means the English language edition of the Olympic Charter (including its bye-laws and any guidelines issued by the IOC relating to the Olympic Charter and/or its bye-laws) in effect from 7 July 2007 and as amended from time to time;
“Olympic Marketing Extranet” means the electronic Extranet site (www.olympicmarketing.com) currently known as Athena;
“Olympic Marks” means any Olympic-related identification, association, marks or designations including the Olympic Symbol, the Olympic Motto, the 2012 Olympic Games Marks, the BOA Marks, any Olympic related word marks, symbols or representations that are protected by the Games Acts and any identification, association, mark or designation that includes the Olympic Symbol;
“Olympic Motto” means the motto “Citius, Altius, Fortius” and any English or other local language translations of the same;
“Olympic Movement” means the movement represented by the Games of the Olympiad and the Olympic Winter Games and those organisations, athletes and other persons who agree to be guided by the Olympic Charter, the goal of which is to contribute to building a peaceful and better world by educating youth through sport practised without discrimination of any kind and in the Olympic spirit, which requires mutual understanding with a spirit of friendship, solidarity and fair play;
“Olympic Rights” means the marketing rights, opportunities and support to be provided to the Supporter in respect of the 2012 Olympic Games, the BOA and Team GB as set out in Schedule 3;
“Olympic Sites” means any locations where the 2012 Olympic Games are to be held, access to which requires a 2012 Olympic Games accreditation or a 2012 Olympic Games ticket and any adjacent areas that are under the control of LOCOG for so long as they are under the control of LOCOG;
“Olympic Symbol” means the five Olympic rings used on its own as depicted in the LOCOG Marks and Imagery Handbook;
“Olympic Torch Relay” means the Olympic torch relay preceding the opening ceremony of the 2012 Olympic Games for which the Olympic flame will be brought to and carried throughout the Territory;
“Paralympic Marks” means any Paralympic-related identification, association, marks or designations including the Paralympic Symbol, the Paralympic Motto, the 2012 Paralympic Games Marks, the BPA Marks and any Paralympic related word marks, symbols or representations that are protected by the Games Acts and any identification, association, mark or designation that includes the Paralympic Symbol;
“Paralympic Motto” means the motto “Spirit in motion” and any other local language translations of the same;
“Paralympic Movement” means the movement represented by the Paralympic Games and the Paralympic Winter Games and those organisations, athletes, officials and other persons or organisations who agree to be guided by the IPC Constitution and Bye-laws, the goal of which is to enable Paralympic athletes to achieve sporting excellence and inspire and excite the world;
“Paralympic Rights” means the marketing rights, opportunities and support to be provided to the Supporter in respect of the 2012 Paralympic Games, the BPA and Paralympics GB as set out in Schedule 3;
“Paralympics GB” means each of the teams representing the Territory in the Beijing 2008 Paralympic Games, the Vancouver 2010 Paralympic Winter Games and the 2012 Paralympic Games;
“Paralympic Sites” means any locations where the 2012 Paralympic Games are to be held, access to which requires a 2012 Paralympic Games accreditation or a 2012 Paralympic Games ticket and any adjacent areas that are under the control of LOCOG for so long as they are under the control of LOCOG;
“Paralympic Symbol” means the three Agitos together with the letters IPC, used on their own as depicted in the LOCOG Marks and Imagery Handbook;

Per “Carta Olimpica” si intende l’edizione in lingua Inglese della Carta Olimpica (ivi compreso il relativo statuto e le linee guida emesse da IOC in relazione alla Carta Olimpica e/o al rispettivo statuto) in vigore dal 7 Luglio 2007 e le successive modifiche e integrazioni nel corso del tempo;
Per “Extranet del Marketing Olimpico” si intende il sito elettronico Extranet (www.olympicmarketing.com) correntemente noto come Athena;
Per “Marchi Olimpici” si intende qualsiasi identificazione, associazione, marchio o designazione di natura Olimpica ivi compresi il Simbolo Olimpico, il Motto Olimpico, i Marchi dei Giochi Olimpici del 2012, i Marchi BOA, qualsiasi marchio, simbolo o rappresentazione di natura Olimpica tutelati dagli Atti dei Giochi nonché qualsiasi identificazione, associazione, marchio o designazione che includano il Simbolo Olimpico;
Per “Motto Olimpico” si intende il motto “Citius, Altius, Fortius” e qualsiasi traduzione in Inglese o in altra lingua locale dello stesso motto;
Per “Movimento Olimpico” si intende il movimento rappresentato dai Giochi dell’Olimpiade e dai Giochi Olimpici Invernali nonché le organizzazioni, gli atleti e tutti coloro che accettino di sottoporsi alle disposizioni della Carta Olimpica, che ha come scopo di contribuire alla costruzione di un mondo migliore e più pacifico educando la gioventù per mezzo dello sport, praticato senza discriminazioni di alcun genere e nello spirito olimpico, che esige mutua comprensione, spirito di amicizia, solidarietà e fair-play;
Per “Diritti Olimpici” si intendono i diritti di marketing, le opportunità e il supporto da fornire al Supporter in relazione ai Giochi Olimpici del 2012, BOA e Team GB, come previsto nell’Allegato 3;
Per “Siti Olimpici” si intende qualsiasi località in cui si terranno i Giochi Olimpici del 2012, il cui accesso richiede un accreditamento ai Giochi Olimpici del 2012 ovvero un biglietto per i Giochi Olimpici del 2012, nonché qualsiasi area adiacente sotto il controllo di LOCOG fintanto che la stessa rimanga sotto il controllo di LOCOG;
Per “Simbolo Olimpico” si intendono i cinque anelli Olimpici così come sono raffigurati sui Marchi LOCOG e nel Manuale Immagini;
Per “Staffetta della Fiaccola Olimpica” si intende la staffetta della fiaccola Olimpica precedente alla cerimonia di inaugurazione dei Giochi Olimpici del 2012 tramite la quale la fiamma Olimpica sarà portata e condotta attraverso il Territorio;
Per “Marchi Paralimpici” si intende qualsiasi identificazione, associazione, marchio o designazione di natura Paralimpica ivi compresi il Simbolo Paralimpico, il Motto Paralimpico, i Marchi dei Giochi Paralimpici del 2012, i Marchi BPA, qualsiasi marchio, simbolo o rappresentazione di natura Paralimpica tutelati dagli Atti dei Giochi nonché qualsiasi identificazione, associazione, marchio o designazione che includano il Simbolo Paralimpico;
Per “Motto Paralimpico” si intende il motto “Spirit in motion” (“Spirito in movimento”) e qualsiasi altra traduzione in lingua locale dello stesso motto;
Per “Movimento Paralimpico” si intende il movimento rappresentato dai Giochi Paralimpici e dai Giochi Paralimpici Invernali nonché le organizzazioni, gli atleti, ufficiali e tutti coloro che accettino di sottoporsi alle disposizioni della Costituzione IPC e dello Statuto, che ha come scopo di permettere agli atleti Paralimpici di raggiungere l’eccellenza sportiva ispirando e smuovendo il mondo;
Per “Diritti Paralimpici” si intendono i diritti di marketing, le opportunità e il supporto da fornire al Supporter in relazione ai Giochi Paralimpici del 2012, BPA e Paralimpica GB, come previsto nell’Allegato 3;
“Paralimpica GB” si intende ciascuna delle squadre che rappresentano il Territorio nei Giochi Paralimpici di Beijing 2008, nei Giochi Paralimpici Invernali di Vancouver 2010 e nei Giochi Paralimpici del 2012;
Per “Siti Paralimpici” si intende qualsiasi località in cui si terranno i Giochi Paralimpici del 2012, il cui accesso richiede un accreditamento ai Giochi Paralimpici del 2012 ovvero un biglietto per i Giochi Paralimpici del 2012, nonché qualsiasi area adiacente sotto il controllo di LOCOG fintanto che la stessa rimanga sotto il controllo di LOCOG;
