Context: This expression appears in the context a legal claim for special damages as well as damages for pain and suffering (UK law).
"If the court is persuaded to award general damages for pain and suffering and loss of amenity, then it is invited to consider [...]"

however, in this context, I was wondering if the whole expression could just be translated as "Schmerzensgeld" (which of course is "damages for pain and suffering"). I've seen "damages for pain and suffering and loss of amenity" translated as just "Schmerzensgeld", but since you've got the "general" as well here, I'm not sure.

Vorschlag im Übrigen: Sofern das Gericht zu der Überzeugung gelangt, dass Schmerzensgeld dem Grunde nach zu gewähren / zuzusprechen ist, möge es berücksichtigen...
oder kürzer: Sofern das Gericht einen Schmerzensgeldanspruch bejaht...
