Verschlusssituation

German to English Other Insurance Investigation into the causes of a fire
This report describes a fire that had broken out in a building rented to a tenant. The roof was currently being repaired. The text is as follows: "Durch das offene Dach lag keine Verschlusssituation vor. Damit stand es dem Vermieter zu keinem Zeitpunkt offen, eine Vertragsstrafe oder außerordentliche Kündigung auszusprechen." I know what they mean but an appropriate term escapes me. Any help would be greatly appreciated!
