agree Wolfgang HULLMANN : Although "penalties" might appear to be a bit too vague for "Sanktionsmaßnahmen", which are more specific. Why not "restrictive measures" or just "sanctions"?

Other options for the verb phrase. I'm on board with David's choice of verb, but would handle 'nach solchen Bestimmungen' in a different way.

..if the provision of such services would open up the insurer to sanctions under the same rules

or:

...if the insurer would risk incurring sanctions under those rules
