Testo originale - Italiano Può sembrare un paradosso, ma per me ecologista italiano la crisi che tormenta da mesi i Verdi francesi è una condizione invidiabile. Litigano e si dividono, dirigenti anche importanti se ne vanno sbattendo la porta, come conferma il deludente risultato ottenuto nelle elezioni regionali sembrano incapaci di trasformare in stabile consenso politico il peso crescente dei temi ambientali tra i cittadini: ma restano, comunque, un protagonista vero, vivo, ascoltato del dibattito pubblico. Questa è stata la mia prima impressione leggendo “Le Manifeste des écologistes atterrés”, nel quale tre esponenti del partito nato anni fa dalla fusione tra “Les Verts” ed “Europe Ecologie” – Lucile Schmid, Édouard Gaudot, Benjamin Joyeux – raccontano la loro amarezza per questa sorta di “collasso” dei Verdi francesi e propongono un percorso di radicale rifondazione “pour une écologie autonome – così si legge nel sottotitolo -, loin du politique circus”.
Sì, provo invidia per le difficoltà nelle quali si dibattono i miei amici e compagni Verdi francesi. Perché in Italia, più semplicemente, i Verdi non hanno nessun ruolo politico da quasi un decennio: formalmente esistono, nei fatti sono fuori dal Parlamento e dalla quasi totalità delle assemblee elettive regionali e locali, fuori dal dibattito pubblico. Eppure in Italia i Verdi hanno una storia importante: siamo stati uno dei primi Paesi europei ad eleggere in Parlamento dei deputati Verdi (era il 1987, le Liste Verdi conquistarono 13 seggi nella Camera dei Deputati), il primo con un ministro Verde (Francesco Rutelli, ministro dell’ambiente nel 1992), il primo ad eleggere nella sua capitale un sindaco Verde (ancora Francesco Rutelli, nel 1993: governerà Roma fino al 2001). Dopo questi iniziali e promettenti successi, per i Verdi italiani è cominciato un rapido declino. Questa parabola così negativa non ha una causa sola. Certamente su di essa ha influito l’infelice dinamica dell’ultimo ventennio italiano, nel quale la politica e la stessa opinione pubblica si sono quasi del tutto polarizzate “pro” o “contro” il fenomeno-Berlusconi e si è molto ridotto lo spazio per “offerte” politiche diverse e lontane dalla dialettica tradizionale destra-sinistra. Questa però è solo una delle spiegazioni. Altre, non meno plausibili, chiamano in causa errori e limiti che hanno segnato negativamente i comportamenti, le scelte, il profilo dei Verdi Italiani. Prima e più grave inadeguatezza: mentre l’attenzione verso l’ecologia cresceva nella società, coinvolgeva bisogni e interessi sempre più larghi e politicamente meno connotati, i Verdi restavano legati a un’impronta da micro-partito di “sinistra radicale”, indigesta per un’ampia fetta di elettorato potenzialmente sensibile al messaggio ecologico. In altri Paesi europei le forze ecologiste hanno saputo adattarsi a questo mutamento di scenario: così in Germania, con il prevalere dei “realos” di Joshka Fischer sui “fundis” di Petra Kelly; così, questa almeno la mia percezione da osservatore esterno, anche in Francia, dove peraltro l’identificazione – e l’auto-identificazione – Verdi-sinistra è sempre stata meno accentuata.
Nel loro libro-manifesto, Schmid, Gaudot e Joyeux sottolineano lo scarto enorme e crescente tra debolezza politica degli ecologisti e diffusione sempre più larga delle idee e delle mobilitazioni ecologiche nella società. Una contraddizione, come giustamente essi richiamano, non solo francese. Anche in questo caso l’Italia, si può dire, “fa scuola”. L’ecologia nel mio Paese è un nano politico e un gigante associativo: con grandi organizzazioni come Legambiente, Wwf, Greenpeace che contano centinaia di migliaia di iscritti; con una miriade di gruppi e comitati civici impegnati in conflitti e mobilitazioni locali; con campagne nazionali di straordinario seguito e successo, basti pensare ai referendum del 2011 nei quali il 95% dei votanti, pari a oltre il 50% di tutti gli elettori, ha ribadito il no all’energia nucleare (già bocciata in un altro referendum nel 1987) e si è espresso per una gestione rigorosamente pubblica delle risorse idriche.
Perché questa distanza così ampia tra ecologia politica in evidente crisi ed ecologia sociale e culturale in progresso? Per Schmid, Gaudot e Joyeux essa nasce essenzialmente dal fatto che i partiti Verdi, in Francia e non solo, finiscono per assomigliare troppo ai partiti loro “concorrenti” – gruppi ristretti e autoreferenziali di dirigenti e di quadri, scarsa comunicazione e condivisione con i militanti, più attenzione alle ambizioni personali di pochi che all’obiettivo di allargare la base associativa – e troppo poco alla radicalità del cambiamento che sono nati per rappresentare e per costruire: “le problème de ces partis alternatifs –essi scrivono – c’est qu’ils sont pour la plupart incapables de s’apppliquer à eux-mêmes les principes qu’ils défendent pour tous” . Insomma, non è così naturale per un cittadino convinto dell’importanza della “ragione ecologica”, identificarsi al momento del voto con partiti e spesso con leader che praticano poco e male, in quanto attori sulla scena politica, le idee di solidarietà, di inclusione, di sobrietà, di convivialità che sono alla base del pensiero ecologico.
Questa diagnosi contiene molta verità, ma io credo che non basti a spiegare perché gli ecologisti – con importanti ma rare eccezioni, prima tra tutte quella tedesca – non siano ancora riusciti ad occupare uno spazio stabile, significativo e diffuso nel paesaggio politico delle nostre società.
Nel “Manifeste des écologistes atterrés” si indica una strada assai netta, la stessa strada – ricordano gli autori – che indicava già quasi trent’anni fa il filosofo Felix Guattari. Come ammoniva Guattari, “pour aboutir à la promotion d’une nouvelle conscience planétaire”, occorre “faire réémerger des systèmes de valeurs échappant au laminage morl, psychologique et social auquel procède la valorisation capitaliste”.
Secondo questa visione, l’ecologia politica può affermarsi solo sulla base di una “conversione” degli individui e delle comunità, di un mutamento quasi antropologico che riavvicini i criteri che governano l’agire umano a sentimenti – “la joie de vivre, la solidarité, la compassion à l’égard d’autrui”, nelle parole di Guattari – , pressoché estranei allo logica individualista, materialista, consumista oggi dominante.
Ora, che l’ecologia politica sovverta molti paradigmi costitutivi dell’idea stessa di modernità, a cominciare dal “mito” di una crescita economica illimitata e illimitatamente benefica, è fuori dubbio. Ma come affermava Alexander Langer, uno dei padri del pensiero verde, questa profonda radicalità da una parte va coltivata anche sul terreno dell’azione politica, dall’altra va tenuta al riparo da qualunque tentazione millenarista. Perché si realizzi una riconversione ecologica della società e dell’economia – questo l’insegnamento di Langer e questo, io credo, il banco di prova decisivo anche oggi per l’ecologia politica – bisogna che essa sia percepita come “socialmente desiderabile” dalla maggioranza delle persone: dunque gli ecologisti e i Verdi, per vincere la sfida democratica del consenso, devono proporre soluzioni, cambiamenti molto concreti e tali da rispondere ai bisogni e alle aspirazioni delle donne e degli uomini “reali”, fuori da ogni mitologia, illusoria oltre che inaccettabile, di un “uomo nuovo” ecologico da modellare secondo le indicazioni di un cenacolo di saggi.
Dunque, il futuro dell’ecologia politica si gioca su due campi complementari: quello, benissimo definito da Schmid, Gaudot e Joyeux, di un modello di rappresentanza politica aperto, leggero, anti-burocratico – l’opposto di tanti partiti Verdi, grandi e piccoli. E quello di una assai maggiore disponibilità a calarsi nelle dinamiche sociali e anche economiche del tempo presente. Per esempio, l’ecologia deve aggiornare il suo sguardo sull’economia: nata come pensiero che proponeva una razionalità più larga e profonda della mera convenienza economica, ormai ha di fronte un’economia che questa più ricca razionalità, proprio sotto la spinta delle idee ecologiche, comincia ad integrare nelle proprie scelte e strategie. Un esempio? Il 2015 sarà dopo secoli il primo anno in cui diminuiranno le emissioni climalteranti causate dall’uomo: un dato impensabile solo dieci anni fa, una straordinaria vittoria simbolica e anche molto concreta delle ragioni ecologiste. Così, oggi i Verdi possono e devono ambire a rappresentare non solo i valori culturali e i bisogni sociali che si richiamano all’ecologia, ma anche gli interessi – gli interessi economici – di una platea sempre più vasta di imprese che si identificano con una prospettiva di economia ecologica.
Per venire infine a un tema quanto mai centrale nel dibattito lacerante che attraversa i Verdi francesi, penso che per rimanere “contemporanea” l’ecologia politica debba liberarsi da un dubbio che l’accompagna da sempre: se definirsi e presentarsi come parte della sinistra o invece coltivare un’identità “altra” dall’antinomia tradizionale destra-sinistra. Anche su questo penso che avesse ragione Langer: gli ecologisti, in quanto sostenitori di un ideale di solidarietà e di interdipendenza – solidarietà dell’uomo verso gli ecosistemi e dei contemporanei verso le generazioni future, interdipendenza tra tutti i fenomeni della vita – sono più vicini a sensibilità di sinistra che di destra, ma i loro criteri di analisi e i loro propositi di trasformazione della società erano e restano quanto mai lontani da quelli della sinistra tradizionale, sia della sinistra riformista che dell’estrema sinistra. Per i Verdi come per ogni famiglia politica la ricerca di alleanze e collaborazioni è una necessità vitale, ma se rinunciano alla loro “differenza” essi rischiano più che la sconfitta: rischiano l’inutilità.
Il “Manifeste des écologistes atterrés” è un libro preoccupato, ma non disperato né pessimista. Fotografa con impietosa nitidezza la crisi attuale dei Verdi francesi , però va oltre. Io condivido in pieno questa fiducia. Penso che l’ecologia politica sia un’idea indispensabile per affrontare i drammi e i problemi del mondo attuale. Indispensabile per fronteggiare la crisi ecologica, indispensabile anche per costruire un sistema più giusto e più equilibrato di relazioni tra le persone e tra i popoli. Come ogni idea, anche questa cammina sulle gambe degli uomini: perciò può cadere, inciampare, zoppicare. Ma in poco più di quarant’anni di vita, un tempo breve nella storia delle idee politiche, ha messo radici profonde nella coscienza dell’umanità: a reciderle non basta né il letargo decennale dei Verdi italiani, né l’accenno di implosione di quelli francesi.
Traduzione - Inglese It may seem paradoxical, but as an Italian environmentalist I view with envy the crisis that has been plaguing the French Greens for months. They squabble and split up; prominent leaders leave slamming the door behind them and, as shown by the disappointing regional election results, they seem unable to turn the growing popular weight of environmental concerns into solid political consensus. Despite all this, however, the French Greens remain real and vibrant leading actors in the public debate and they are listened to. This has been my first impression after reading “Le Manifeste des écologistes atterrés”, in which three exponents of the party born years ago from the union of “Les Verts” and “Europe Ecologie” – Lucile Schmid, Édouard Gaudot and Benjamin Joyeux – recount their bitterness at this sort of “collapse” of the French Greens and put forward a radical reformation path “for an autonomous ecology” – as the subheading states – “far from the political circus” (“pour une écologie autonome loin du politique circus”).
Yes, I envy the difficulties besetting my French Green friends and fellow campaigners. Because in Italy, more simply, the Greens have had no political role for nearly a decade. Formally they exist, but in reality they are out of Parliament, out of almost all regional and local elective assemblies and out of the public debate. And yet the Italian Greens have an important history. Italy was one of the first European countries to elect Green MPs (it was 1987 and the Green Lists won 13 seats in the Chamber of Deputies), the first country to have a Green minister (Francesco Rutelli, Minister for the Environment in 1992) and to elect a Green mayor in its capital city (Francesco Rutelli again, in 1993, who was mayor of Rome until 2001). But after these first promising results, the Italian Greens embarked on a rapid decline. This negative trajectory has more than one cause. One influence has undoubtedly been the unfortunate dynamics of the last two decades in Italy, where politics and public opinion have almost entirely polarized “for” or “against” the Berlusconi issue, thus considerably reducing the scope for different political “offers” away from traditional right-left dialectics. But this is only one explanation. Others, no less plausible, relate to the mistakes and limitations that have negatively affected the behaviours, choices and profile of the Italian Greens. Their first and most serious shortcoming was that at a time when society’s awareness of green issues was growing and involved ever-increasing needs and interests marked by fewer political connotations, the Italian Greens held on to their “radical left” small party identity, unpalatable to a large section of the electorate that was potentially sensitive to the environmental message. In other European countries environmental forces were able to adapt to this changed scenario, as in Germany, where Joshka Fischer’s “realos” prevailed over Petra Kelly’s “fundis”. This, at least, is my perception as an outside observer, which also applies to France where, however, the Greens’ identification – and self-identification – with the Left has always been weaker.
In their manifesto book, Schmid, Gaudot and Joyeux emphasize the huge and growing gap between the political weakness of environmentalists and the ever-increasing spread of environmental ideas and actions within society. As they rightly point out, this contradiction is not just a French phenomenon. Here again Italy leads the way, so to speak. In my country, the environment is a political dwarf and an organizational giant, with large associations like Legambiente, WWF and Greenpeace numbering hundreds of thousands of members and with myriads of groups and civic committees engaged in local battles and actions. Italy also has extraordinarily large and successful national campaigns, such as the 2011 referenda in which 95% of voters, accounting for over 50% of all electors, again said no to nuclear energy (after it had been rejected in a previous referendum in 1987) and opted for full public management of water resources.
What is the reason for this large gap between the obvious crisis besetting environmental politics and the evident progress being made by social and cultural environmentalism? According to Schmid, Gaudot and Joyeux, this essentially stems from the fact that Green parties, in France as elsewhere, end up resembling too much their “rivals” – with small, self-referential groups of party leaders and officials, poor communications with and involvement of activists and more focus on the personal ambitions of a few individuals than on broadening the party support base – and not enough the radical change they were set up to represent and build upon. According to the authors, “the problem with these alternative parties is that for the most part they are incapable of applying to themselves the principles which they advocate for all” (“le problème de ces partis alternatifs c’est qu’ils sont pour la plupart incapables de s’apppliquer à eux-mêmes les principes qu’ils défendent pour tous.”). In conclusion, a voter convinced of the importance of the “environmental cause” does not identify naturally with parties and often with leaders who, as political actors, do not sufficiently live up to the solidarity, inclusion, sobriety and conviviality ideals that are at the base of environmental ideology.
Although there is much that is true in this analysis, I believe that it is not enough to explain why environmentalists – with notable but rare exceptions such as, first and foremost, Germany – have not yet managed to secure a stable, meaningful and far-reaching space in the political landscape of our societies.
“Manifeste des écologistes atterrés” shows a very clear road ahead, the same road – the authors remind us – that was shown nearly thirty years ago by the philosopher Felix Guattari. As Guattari warned then “to bring about the promotion of a new global conscience” we need to “contribute to deliver values systems that would eschew the moral, psychological and social flattening operated by capitalism” (“faire réémerger des systèmes de valeurs échappant au laminage morl, psychologique et social auquel procède la valorisation capitaliste.”).
According to this vision, environmental politics can only become established on the basis of a “conversion” by individuals and communities, of an almost anthropological change that brings emotions closer to the criteria governing human actions – or, in Guattari’s words, “Joie de vivre, solidarity, compassion towards others” which are almost alien to today’s prevailing individualistic, materialistic and consumeristic logic.
There is no doubt that environmental politics subverts many constituent paradigms of the very idea of modernity, starting from the “myth” of unlimited beneficial economic growth. But as stated by Alexander Langer, one of the fathers of green ideology, this profound radicalism on the one hand has to be also cultivated at the level of political action and, on the other, it must be protected from any millenarist temptation. For an environmental reconversion of society and economy to take place – which is Larger’s lesson to us and which, I believe, is still the decisive test bench for today’s environmental politics – it must be perceived as “socially desirable” by the majority of people. For environmentalists and Greens to win the challenge of consensus democracy, therefore, they must propose very concrete solutions and changes capable of meeting the needs and aspirations of “real” women and men, away from any illusory and unacceptable myth of a “new environmental man” to be moulded according to the instructions of a coterie of sages.
The future of environmental politics, therefore, will be played out on two complementary fields. One, defined very ably by Schmid, Gaudot and Joyeux, is based on an open, light and anti-bureaucratic model of political representation – the direct opposite of many small and large Green parties. The second, on the other hand, relies on a much greater willingness to identify with current social and economic forces. Environmentalism, for instance, must update its views on the economy. Born as an ideology that proposed a wider and deeper rationality than mere economic convenience, environmentalism is now faced with an economy that is starting to be integrated into the choices and strategies of this richer rationality under the thrust of environmental ideas. An example of this is the fact that 2015 will be, after many centuries, the first year seeing a reduction in man-made climate-changing emissions. This would have been unthinkable only ten years ago and represents and extraordinary symbolic – as well as concrete – victory for environmental causes. Today, therefore, Greens can and must aim to represent not only cultural values and social needs based on environmental principles, but also the economic interests of an ever-increasing audience of businesses identifying with the tenets of environmental economics.
And to come, finally, to a topic that is most central to the agonizing debate currently afflicting the French Greens, I think that in order to stay “contemporary” environmental politics must free itself of an eternal doubt: whether to define and present itself as part of the left, or whether to cultivate “another” identity away from the traditional right-left dichotomy.
I believe that Langer was right on this point too. Environmentalists, as supporters of an ideal based on solidarity and interdependence – the solidarity of man to ecosystems and of current to future generations, as well as the interdependence of all life’s phenomena – are closer to left-wing than to right-wing sensibilities. However, their analysis criteria and their intentions for transforming society were, and still are, very far from those of the traditional reformist and far left. For the Greens, as for any political family, the quest for alliances and collaborations is a vital necessity, but if they give up their “difference” they risk more than defeat: they risk futility.
“Manifeste des écologistes atterrés” is a concerned book, but it is not a desperate or a pessimistic book. It captures with ruthless clarity the current crisis of the French Greens, but it also goes beyond it. I fully share its confidence. I believe that, as an idea, environmental politics is essential for addressing the tragedies and problems of todays’ world. It is also essential for facing the environmental crisis and building a fairer and more balanced system of relations between individuals and peoples. As with any idea, this too walks on the legs of men and as such it can fall, stumble and hobble. But in little over forty years – a short time in the history of political ideas – it has put down deep roots in the conscience of humankind. The decade-long hibernation of the Italian Greens, or the hint of implosion of their French counterparts, will not be enough to sever them.

In consideration of the payment to be made by the Licensee to the Owner and the of terms and conditions hereafter contained, the Owner hereby agrees subject to specific health and safety exclusions that the Licensee may use the Premises 24/7 being part of the Building but with the benefit of lighting and heating to the Premises between the hours of 8am and 8pm Monday to Friday in each week and the right to use the communal kitchen for making of tea and coffee.
2. This Licence Agreement is for a minimum period defined as the Initial Licence Period. Either party may give each other not less than two month's written notice served in advance terminating the Licence but without prejudice to the claim by the Owner against the Licensee in respect of any arrears of the Licence Fee or any breach of the agreements and undertakings herein contained on the part of the Licensee. The Licence Fee will be reviewed at the end of the initial period and an appropriate increase applied to the monthly licence fee. If no termination notice is received this Licence Agreement will roll over for successive periods of two months with a minimum increase at least 10% every two months [for a maximum term of 24 months from the commencement date] until
terminated or a new Initial Licence Period is agreed.
3. The Licence Fee is inclusive of uniform business rates (for which the Owner shall act as agent for the Licensee and benefit from any relief applicable on the Premises), water rates, heating, lighting and cleaning of the communal parts of the Building and the Premises payable monthly in advance by Direct Debit.
4. On signing, the Licensee shall provide to the Owner a Service Retainer equal to 2.35 times the monthly Licence Fee. The Owner shall be entitled to increase the Service
Retainer to an appropriate level to cover additional services usage should this exceed the amount of the standard Service Retainer. In the event of the Licensee failing to pay the Licence Fee or otherwise becoming indebted to the Owner on account of any breach of
the stipulations and conditions contained in this Licence, the Owner shall be entitled without terminating the Licence to withdraw all services and exclude the Licensee from the Premises and utilise the Service Retainer towards discharge of any such debt or other matter as aforesaid. In addition on termination by the Owner or Licensee, or in the event of a breach by the Licensee, the
Owner has the right to take lien over any goods and chattels left in the Premises and to dispose of
such items and use the proceeds towards the discharge of any debt.
5. This Licence does not give the Licensee exclusive possession of any part of the Premises.
6. This Licence is granted to give the Licensee the benefit of temporary offices for a limited period in the Premises under the management and control of the Owner. Any other agreements made between the Owner and its related companies and the Licensee will not necessarily terminate when this Licence Agreement ends.
7. The Owner, in who control of the Premises remains, reserves the right to enter the Premises or any part thereof at anytime in case of emergency or for entry for any other proper reason on 24 hours previous notice during usual business hours.
8. This Licence is personal to the Licensee and it cannot be transferred. The Licensee is not entitled to permit anyone other than those employed by or having business with the Licensee to have access to the Premises.
9. The Owner shall not be liable to the Licensee for any personal injury, damage, loss or inconvenience howsoever or wheresoever caused to the Licensee or to any goods or chattels brought by any person upon the Premises. It being the intention of and agreed
between the parties hereto that the Licensee in exercising the right shall do so at the riskof the Licensee and accordingly the Licensee agrees to indemnify the Owner against all claims for any lawful visitor to the Premises who shall have entered onto the Premises for the purpose of lawfully visiting the Licensee or who shall enter the Premises with the permission of the Licensee.
10. The Licensee agrees with the Owner as follows. -
i) To pay the Licence Fee in advance by Direct Debit by the fifth day of every calendar month during the period of this Licence. Any Licence Fee not paid by Direct Debit will
incur a charge of £50.00 per month.
ii) If the Licence Fee is not paid by the fifth day of each calendar month then the Licensee will pay a surcharge of 5% of the amount outstanding on any Licence Fee per month, subject to a minimum charge of £50. Any payments to the Owner, which require re-presentation to clear, will incur a £50 administration fee.
iii) To pay for all other outgoings payable by Direct Debit in respect of the Premises other than those included in the Licence Fee including charges made by the Owner for the use of any business support services. Such charges unpaid for more than seven days from the date the Licensee was notified that such sum was due, will incur a 5% surcharge on the amount outstanding per month, subject to a minimum charge of £50.
iv) To make good to the satisfaction of the Owner any damage to the Premises which may be caused in the exercise of or in connection with the rights and liberties hereby confirmed either by the Licensee or by any other person invited by the Licensee to the Premises or to any part of the Building or to any of the fixtures and fittings. To take care of the fixtures and fittings in the Premises and not to remove any part thereof from the Premises. A minimum standard redecoration charge of £75.00 per workstation will be levied at the end of the period of occupancy as deemed appropriate by the Owners
inspection; v)Not to cause or permit the Premises to be used or occupied in any way or for any purpose which would cause any nuisance to the Owner or the occupants of any
neighbouring or adjacent premises and office suites, including but not restricted to the
satisfactory disposal of any hazardous waste;
vi) Not to make any alterations whatever to the Premises or any fixtures or fittings thereof without the prior consent in writing of the Owner;
vii) Not to display the name of the Licensee or any business carried on by the Licensee save in a manner approved by the Owner or to display any notice or advertisement either on the outside of the Premises or which would be visible from outside the Premises;
viii) Not to attempt or purport to assign the benefit of this Licence;
ix) Not to deal with or part with the rights hereby granted over the Premises or any part thereof;
x) To keep the Owner indemnified against all damage, loss and injury of every description which may occur to or affect the Owner or its property which may arise from the non-observance of any of the stipulations of this Licence howsoever expressed or implied;
xi) To effect insurance in respect of public liability, contents and any other risks which may arise or be appropriate under the terms of this Licence and to produce such policies to the Owner on demand;
xii) To vacate the Premises and remove all the Licensee's property on the expiration of this Licence and to leave the Premises in the state in which it was originally. The Owner
may charge dilapidations in addition to the redecoration charge if the Premises are not vacated in the state originally licensed. The Owner may also charge a fee for storage of items which are not removed in accordance with the foregoing;
xiii) To comply, at the Licensee's expense, with all statutory and any other regulation concerning the Premises and to indemnify the Owner against any claims arising from any breach of such regulations;
xiv) To observe any security regulations or management regulations for the use of the Premises or the Building which the Owner may make from time to time;
xv) Not to invite the public generally to come to the Premises nor to use it for a purpose which attracts casual callers;
xvi) Not to act in a way which will or may result in the insurance of the Building being void or avoidable or in the premium for it being increased nor to allow anyone else so to do;
xvii) Not to solicit or to employ during the period of this Licence and for a period of 6 months after the termination of this licence any existing employee of the Owner, save for an agreement between the Owner and the Licensee by payment of 30% of the Employees annual salary at the time of the employees resignation by the Licensee to the Owner.
xviii) To use the Owner's telecoms and Internet connectivity facilities and pay for all telephone call charges and Internet connectivity charges. Not to connect directly to any other telecoms provider including least cost routing and voice over IP telephony over the
Owners telecom circuit or any other Internet connectivity solutions.
xix) To use the communal tea points solely for the provision of tea and coffee.
xx) To agree to automatically contract to an MLS 'Start' agreement for a period of 3 months following the end of the Licensee's period of occupancy for the purpose of call and mail forwarding.
11. Notice
i) Any notice required or permitted to be given hereunder shall be given in writing
delivered personally or sent by first class post prepaid recorded delivery (air mail if
overseas) addressed to the party due to receive such notice at, in the case of a company,
its registered office from time to time or, in the case of an individual, his address as set
out in this Agreement (or such address as he may have notified to the other parties in
accordance with this Clause);
ii) Any notice delivered personally shall be deemed to be received when delivered to the
address provided in this Agreement and any notice sent by prepaid recorded delivery
post shall be deemed (in the absence of evidence of earlier receipt) to be received 48
hours after posting (6 days if sent air mail) and in proving the time of dispatch it shall be
sufficient to show that the envelope containing such notice was properly addressed,
stamped and posted. Any notice sent by facsimile transmission shall be deemed to have
been received at the time of transmission.
12. This agreement shall be subject to the law of England and Wales.

In considerazione del pagamento che dovrà essere effettuato dal Licenziatario a favore del Proprietario e dei termini e delle condizioni qui di seguito esposti, il Proprietario concorda che, fatte salve le eventuali esclusioni applicabili in materia di salute e sicurezza, il Licenziatario avrà diritto all’uso dei Locali facenti parte dell’Immobile senza alcun limite di orario, usufruendo tuttavia del beneficio dell’illuminazione e del riscaldamento degli stessi unicamente nel periodo compreso tra le ore 8.00 e le ore 20.00 dal lunedì al venerdì di ciascuna settimana, nonché dell’impiego della cucina comune per il consumo di the e caffè.
2. Il presente Contratto di Licenza ha effetto per un periodo minimo di validità, definito ‘Periodo Iniziale di Licenza’. Le Controparti avranno la facoltà reciproca di richiedere la risoluzione del Contratto di Licenza previo preavviso, tramite comunicazione scritta, di non meno di due mesi senza pregiudizio alcuno per il diritto di rivendicazione da parte del Proprietario nei riguardi del Licenziatario per eventuali arretrati nel pagamento delle commissioni di Licenza o per qualsivoglia violazione da parte dello stesso degli accordi e degli impegni qui pattuiti. Al termine del periodo iniziale le commissioni di Licenza saranno oggetto di revisione con l’applicazione di un opportuno incremento al valore mensile delle stesse. In mancanza di alcun avviso di risoluzione il presente Contratto di Licenza rimarrà in vigore per periodi bimensili consecutivi con l’applicazione di un incremento minimo del 10% ogni due mesi [per un termine massimo di 24 mensilità dalla data d’inizio] fino alla sua risoluzione o ad avvenuto accordo di un nuovo Periodo Iniziale di Licenza.
3. La Commissione di Licenza è comprensiva di imposte uniformi sui beni delle imprese (in merito alle quali il Proprietario agirà in qualità di agente del Licenziatario, usufruendo di qualsivoglia sgravio eventualmente applicabile ai Locali), e di spese per l’acqua, riscaldamento, illuminazione e pulizia delle aree comuni dell’Immobile e dei Locali, pagabili mensilmente in anticipo tramite addebito diretto.
4. Al momento della firma, il Licenziatario dovrà corrispondere al Proprietario un Onorario di Servizio pari a 2,35 volte il valore della Commissione di Licenza mensile . Il Proprietario avrà diritto all’applicazione di un opportuno incremento all’Onorario di Servizio in misura necessaria a coprire un ulteriore uso dei servizi qualora tale uso superi l’ammontare dell’Onorario di Servizio standard. In caso di mancato pagamento da parte del Licenziatario della Commissione di Licenza o di altro debito nei confronti del Proprietario dovuto a violazione delle disposizioni e condizioni relative agli obblighi contenuti nella presente Licenza, il Proprietario avrà diritto, senza che ciò comporti peraltro la risoluzione del contratto di Licenza, a ritirare tutti i servizi e ad escludere il Licenziatario dall’uso dei Locali e ad utilizzare l’Onorario di Servizio per il pagamento dei debiti o di altre spese come da precedente paragrafo. Inoltre, in caso di risoluzione da parte del Proprietario o del Licenziatario, o nell’eventualità di violazione da parte del Licenziatario, il Proprietario avrà diritto di ritenzione in merito ad eventuali beni mobili lasciati nei Locali e di disporre a piacimento degli stessi utilizzando i proventi ai fini dell’estinzione di eventuali debiti.
5. La presente Licenza non conferisce al Licenziatario la proprietà esclusiva di alcuna parte dei Locali.
6. La presente Licenza ha lo scopo di concedere al Licenziatario il beneficio di uffici provvisori, per un periodo di tempo limitato, nell’ambito dei Locali sotto il controllo e la gestione del Proprietario. Gli altri accordi eventualmente stipulati tra il Proprietario, le sue società e il Licenziatario non avranno necessariamente termine alla risoluzione del presente Contratto di Licenza.
7. Il Proprietario, al quale rimane il controllo dei Locali, si riserva il diritto di entrare negli stessi o in qualsivoglia parte degli stessi in qualsiasi momento in caso di emergenza, o per qualsiasi altro buon motivo, previo preavviso di 24 ore durante il normale orario lavorativo.
8. La presente Licenza ha validità personale e non potrà essere trasferita dal Licenziatario. Il Licenziatario non avrà facoltà di consentire l’accesso ai Locali a persona alcuna all’infuori del personale assunto dal Licenziatario o di chiunque altro abbia rapporti d’affari con lo stesso.
9. Il Proprietario non sarà ritenuto responsabile nei confronti del Licenziatario di lesioni, danni, perdite o inconvenienti comunque od ovunque cagionati al Licenziatario stesso o a qualsiasi bene mobile introdotto da terzi nei Locali. E’ intenzione delle controparti del presente contratto, le quali hanno così convenuto, che il Licenziatario eserciti i propri diritti interamente a suo rischio e che di conseguenza Egli si impegni ad indennizzare il Proprietario contro tutte le rivendicazioni relative a qualsiasi persona terza che entri lecitamente nei Locali con il legittimo scopo di visitare il Licenziatario o che vi si introduca con il permesso dello stesso.
10. Il Licenziatario concorda quanto segue con il prietario: -i) Di pagare anticipatamente la Commissione di Licenza tramite Addebito Diretto entro il giorno cinque di ciascun mese solare per tutto il periodo di validità della presente Licenza. Il mancato pagamento della Commissione con il metodo dell’Addebito Diretto andrà incontro a un onere di 50 lire sterline mensili. ii) Il mancato pagamento della Commissione di Licenza entro il quinto giorno di ogni mese solare comporterà il versamento di una maggiorazione da parte del Licenziatario pari al 5% della commissione insoluta, con l’applicazione di un onere minimo di 50 lire sterline. Qualsiasi pagamento a favore del Proprietario che richieda la ripresentazione per l’approvazione da parte della banca andrà incontro ad una commissione amministrativa di 50 lire terline. iii) Di pagare, tramite Addebito Diretto, tutte le altre spese relative ai Locali in aggiunta a quelle incluse nella Commissione di Licenza, ivi compresi gli oneri imposti dal Proprietario per l’utilizzo di qualsiasi servizio di supporto aziendale. Il mancato pagamento di tali spese per un periodo superiore a sette giorni dalla data di notifica al Licenziatario del dovuto versamento, andrà incontro ad una maggiorazione del 5% mensile sull’importo dovuto, con un onere minimo di 50 lire sterline. iv) Di riparare, a soddisfazione del Proprietario, qualsiasi danno ai Locali eventualmente arrecato dall’esercizio di o in relazione ai diritti e ai privilegi qui stipulati dal Licenziatario o da qualsiasi altra persona da Egli invitata nei Locali o in qualsiasi parte degli stessi o in loro prossimità. Di prendersi cura degli accessori e dei suppellettili d’arredo dei Locali e di non rimuovere alcuna parte degli stessi dai Locali suddetti. Al termine del periodo di occupazione verrà imposto un onere minimo standard di 75 lire sterline per ciascuna postazione di lavoro per le spese di ripristino relative alle stesse qualora il Proprietario lo ritenga opportuno a seguito di ispezione; v) Di non consentire o provocare mai l’utilizzo o l’occupazione dei Locali in alcun modo o per alcun fine che potrebbe arrecare disturbo al Proprietario o agli occupanti dei locali e degli uffici limitrofi o attigui, compreso, ma non a titolo esaustivo, lo smaltimento di scorie pericolose anche se effettuato in maniera soddisfacente; vi) Di non apportare modifiche alcune ai Locali o agli accessori e suppellettili d’arredo degli stessi senza la previa autorizzazione scritta del Proprietario; vii) Di non esibire il nome del Licenziatario o qualsiasi attività intrapresa dallo stesso salvo in maniera approvata dal Proprietario, o di non esporre avvisi o annunci pubblicitari sulla parte esterna dei Locali o in maniera che siano visibili dal loro esterno; viii) Di non cercare o pretendere di assegnare a terzi i benefici della presente icenza; ix) Di non trattare o cedere a terzi i diritti conferiti in virtù del presente accordo relativamente ai Locali o a qualsiasi parte degli stessi; x) Di indennizzare il Proprietario di tutti i danni, perdite e lesioni di qualsiasi genere che potrebbero insorgere o interessare il Proprietario o la proprietà dello stesso a causa dell’inosservanza di qualunque delle condizioni della Licenza comunque espresse o sottintese; xi) Di effettuare l’assicurazione contro la responsabilità civile, il contenuto e qualsiasi altro rischio che potrebbe insorgere o essere opportuno in base alle condizioni della presente Licenza, nonché mettere a disposizione del Proprietario, su richiesta, le relative olizze; xii) Di sgomberare i Locali e rimuovere tutti i beni del Licenziatario alla scadenza della presente Licenza, lasciando i Locali nello stato in cui si trovavano all’inizio. Il Proprietario potrà imporre un onere di dilapidazione in aggiunta alla commissione di restauro qualora i Locali non siano stati lasciati nelle condizioni originali oggetto di Licenza. Il Proprietario potrà altresì richiedere il pagamento di una commissione di magazzinaggio per gli articoli che non vengano sgomberati in conformità a quanto esposto in precedenza; xiii) Di osservare, a spese del Licenziatario, tutte le disposizioni di legge e di altro tipo relative ai Locali, nonché di indennizzare il Proprietario a seguito di qualsiasi rivendicazione derivante dalla violazione di tali disposizioni; xiv) Di attenersi ai regolamenti di sicurezza o di gestione relativi all’utilizzo dei Locali o dell’Immobile che il Proprietario potrebbe di tanto in tanto redigere; xv) Di non invitare il pubblico in generale a frequentare i Locali, né di utilizzare gli stessi per scopi atti ad attirare visite casuali; xvi) Di non agire in maniera da provocare l’annullamento o l’annullabilità dell’assicurazione dell’Immobile o l’incremento del premio assicurativo, né di consentire ad altri di agire in tal maniera; xvii) Di non assumere o sollecitare all’assunzione, durante il periodo di validità della presente Licenza e per un periodo di sei mesi dopo la scadenza della stessa, di qualsiasi dipendente in essere del Proprietario , salvo specifico accordo tra il Proprietario e il Licenziatario per il pagamento, da parte del Licenziatario a favore del Proprietario, del 30% dello stipendio annuo del dipendente interessato al momento delle dimissioni dello stesso; xviii) Di usare i servizi di connettività telefonica e internet del Proprietario e di pagare tutte le spese relative alle chiamate telefoniche e alla connettività internet. Di non collegarsi direttamente ad alcun altro fornitore telefonico neppure per la fornitura di servizi di instradamento di chiamate verso l’operatore di minimo costo, di voce tramite protocollo internet mediante il circuito telefonico del Proprietario o di qualsiasi altra soluzione di connettività internet. xix) Di utilizzare i punti di ristoro comuni unicamente per la preparazione di the e caffè. xx) Di impegnarsi a stipulare automaticamente un contratto 'Start' MLS per un periodo di tre mesi dalla data di scadenza del periodo di occupazione del Licenziatario, ai fini dell’inoltro di posta e chiamate.
11. Preavvisi
i) Qualsiasi preavviso richiesto o concesso in virtù del presente accordo dovrà essere comunicato in forma scritta e consegnato di persona o inviato mediante posta prioritaria certificata prepagata (e per via aerea se si tratta di consegna estera) indirizzata alla controparte destinataria del preavviso al recapito della sede centrale in caso di società oppure, nel caso di un individuo, al recapito personale dello stesso indicato nel presente Accordo (o all’indirizzo da lui comunicato alle altre controparti in conformità alla presente Clausola);
ii) Qualsiasi preavviso consegnato di persona sarà ritenuto ricevuto una volta recapitato all’indirizzo indicato nel presente Contratto e qualsiasi avviso inviato mediante posta certificata prepagata sarà considerate ricevuto (in assenza di prova di ricezione antecedente) 48 ore dall’invio (o 6 giorni se inviato per via aerea); a prova dell’ora di spedizione sarà sufficiente mostrare che la busta contenente il preavviso è stata correttamente indirizzata, francata e impostata. Qualsiasi preavviso inviato mediante facsimile sarà ritenuto ricevuto al momento della trasmissione.
12. Il presente Contratto sarà soggetto alla legge inglese e gallese.
