12.4 If the Contractor engages a Sub-Contractor or Sub-Contractors to provide such additional services as are referred to in clause 12.1 but is deemed to have done so not as agent for the Trader but as a principal, then the same terms and conditions (with any necessary textual variations) as apply between the Contractor and such Sub-Contractor (for example, in relation to shipments on board chartered vessels, Gencon charterparty conditions, Heavycon conditions, Towcon conditions or, as the case may be, crane hire/contract lift conditions) shall apply to the Contractor's liability to the Trader but only to such extent as results in a lessening of the Contractor's liability to the Trader. Full details of such other terms and conditions are available to the Trader on written request to the Contractor.
