La réponse à votre interrogation se situe à l'art. précédent du FAMILY CODE californien : section 4061. The amounts in Section 4062 shall be considered additional support for the children and shall be computed in accordance with the following: on y traite que de "additional support" et non de "deduction".
Toutefois, le point d) de cette section 4061 fait état de "For purposes of computing the adjusted net disposable income
of the parent paying child support for allocating any additional
expenses pursuant to Section 4062, the net disposable income of the
parent paying child support shall be reduced by the amount of any
basic child support ordered to be paid under subdivision (a) of
Section 4055." --> la réduction/déduction se rapporte au revenu net disponible du parent et non à une déduction du child support. C'est ce que je lis dans cette loi.

Donc pour moi c'est plutôt que le tribunal DOIT "considerer comme complémentaires" certains frais, ou PEUT considerer comme supplémentaires certains frais (dans le deuxième cas, la deduction est moins probable...) |
