I think, "weighing of the evidence' would be the preferred term in this context. Compare with examples below:

Was mich hier stutzig macht, ist die Bedeutung von Würdigung. Ist das immer ein assessment oder kann das auch ein acknowledgement sein? Danke nochmals, an alle!
Man könnte das so lesen (aber bitte, ohne den Sachverhalt zu kennen = ganz ohne Gewähr!):
Das Bundespatentgericht hat zu den M. 1 und 3 (xxx) im angefochtenen Beschluß in tatrichterlicher Würdigung//, die von der Rechtsbeschwerde nicht angegriffen wird und aus Rechtsgründen auch nicht zu beanstanden ist, //angenommen,...."
[dabei bezieht sich die Würdigung nicht auf "annehmen" - sondern nur zurück auf "zu den Merkmalen" und diese sind qualifiziert durch durch zwei präpositionale Bestimmungen (1. wo? im .. Beschluss 2. was für ein B.? in der Würdigung des Tatrichters = seiner Überzeugung nach)
Das wäre ein Hauptsatz, unterbrochen durch einen Relativsatz, der sich NUR auf Würdigung bezieht. Wenn man den mal ganz weglässt, ist es vielleicht etwas einfacher
Dafür gibt's was im BGB-Kommentar, muss ich aber raussuchen.
Steht hier wirklich, dass das BPG in tatrichterlicher Funktion tätig wird? Kann ich mir nicht vorstellen...
