Italiano term

atto costitutivo (di un fondo patrimoniale)

Da Italiano a Inglese Legale/Brevetti Legale (generale) Writ of Summons
I know atto costitutivo appears several times already in the glossary, but I need to know what term is used (in U.S. English) in relation to the establishment of a fondo patrimoniale.
Would you use the term Deed of Incorporation?

Thanks

Discussion

DCypher (X) Oct 19, 2007:
the nature of the trust is extremely important in choosing the correct term. "Wikipedia" answers are not very helpful.
Richard Hall Oct 17, 2007:
Has the fund been incorporated? i.e., is it a company?

Trust document (or a trust fund)

If it were incorporated, which would be unusual for a family trust, then "articles of association".

From the links below:
"Il fondo patrimoniale consiste in un vincolo posto nell'interesse della famiglia su di un complesso di beni determinati (immobili, mobili registrati o titoli di credito) e realizza la costituzione di un patrimonio separato o di destinazione, con limitazione dei poteri dispositivi dei costituenti (ciascuno o un ambedue i coniugi, un terzo, anche per testamento). "

"Creation

Trusts can be created by written document (express trusts) or they can be created by implication (implied trusts).

Typically a trust is created by one of the following:

1. a written trust document created by the settlor and signed by both the settlor and the trustees;
2. an oral declaration;[5]
3. the will of the settlor; or
4. a court order (for example in family proceedings).
