Une animation extraordinaire régnait dans les bureaux de l’O.H.L. (oberste Heeresleitung, commandement suprême). Tous les services quittaient Coblence et devaient être réinstallés le lendemain matin 30 aout à Luxembourg, capitale du Grand-Duché. Partout, des secrétaires et des plantons ficelaient des dossiers, pressés par les officiers hautains et impatients.
Le communiqué officiel du 27 août venait de secouer l’Allemagne tout entière d’un choc électrisant : « Les armées allemandes de l’Ouest ont pénétré sur le sol français en livrant sans cesse des combats victorieux. De Cambrai aux Vosges méridionales, l’ennemi a été partout battu et est en pleine retraite. Il n’est pas encore possible d’évaluer l’ampleur des pertes de l’ennemi en tués, prisonniers et trophées, en raison de l’étendue formidable des champs de bataille, en terrain en partie couvert, boisé et montagneux. »
La Ire Armée du général von Kluck avait battu les Anglais à Mons le 23 août. Contre les Français, la IIe Armée de von Bülow l’avait emporté le même jour sur la Sambre, dans la région de Charleroi ; la IVe Armée du duc de Wurtemberg s’était avancée dans les Ardennes et la Ve Armée du Kronprinz impérial en Woëvre : les 20 et 21 août, la VIe Armée du Kronprinz Ruprecht de Bavière et la VIIe Armée du von Heeringen avaient été victorieuses en Lorraine. La Ire Armée avait remporté une autre victoire sur les Anglais au Cateau, à l’est de Cambrai, le 26 août. Le 27, le général Helmuth von Moltke, chef d’état-major général, avait soumis à l’empereur, chef suprême, les directives générales pour la continuation des opérations. Ce document se terminait par ces mots : « Sa Majesté ordonne que les armées allemandes marchent sur Paris. »
Les officiers hautains et impatients de l’O.H.L. trouvaient que le déménagement vers Luxembourg était tout à fait insuffisant, qu’il eût fallu s’avancer plus loin, déjà beaucoup plus loin pour suivre l’irrésistible mouvement des armées, pour être certain de pouvoir a temps se jeter en avant, se précipiter au milieu des troupes victorieuses qui entreraient dans Paris.
Le triomphe ne faisait aucun doute et tous les officiers de l’O.H.L. pensaient qu’ils méritaient, comme tous les officiers de toutes les armées allemandes, d’y participer. La victoire sensationnelle maintenant à portée de la main n’était pas le résultat d’un hasard heureux ni du néant de l’adversaire. Une force française de plus un million d’hommes était en pleine retraite après seulement quelques jours de combat parce que le commandement allemand avait manifesté une supériorité écrasante dans tous les domaines : discipline, instruction des troupes, emploi des armes, organisation de tous les services, tactique, stratégie d’ensemble. Depuis de nombreuses années, le corps des officiers avait travaillé obstinément à forger l’arme de la victoire. Et le génial stratège de qui le plan avait été mis en couvre, le junker prussien von Schlieffen, monoclé, corseté guindé, était un authentique représentant de la caste – le mot ne déplaisait nullement à ceux qui en faisaient partie – honorée comme l’élite de la nation allemande.
En temps de paix les grands états-majors préparent la guerre, c’est leur métier. Après 1875, la révolution de la politique européenne avait amené le grand état-major allemand à envisager l’éventualité d’une guerre sur deux fronts. Le vieux maréchal Moltke, le vainqueur de 70, avait déclaré qu’en ce cas il faudrait s’en prendre d’abord aux armées russes en restant sur la défensive du côté français. L’ensemble fortifié Thionville-Metz-Strasbourg, prolongé par le Rhin de Strasbourg à Bâle, était infranchissable. La Russie liquidée, on se tournerait vers la France. Waldersee, successeur (1838-1891) du maréchal, avait maintenu cette conception.
Dès son arrivée, von Schlieffen avait déclaré le plan Moltke périmé, hors d’usage, incompatible avec les nécessités et les possibilités des armées modernes :
– Le réseau ferré de la Russie est misérable. Il faudra à l’état-major du Tsar six semaines pour amener une armée à notre frontière et plusieurs mois pour entreprendre une offensive d’importance. Or nous pouvons écraser la France en moins de deux mois. Il faut commencer par là, en laissant une faible couverture du côté russe.
« Il serait stupide d’envisager l’action militaire contre la France comme un coup de boutoir sur le petit espace de la frontière franco-allemande. Nos masses armées d’aujourd’hui ont besoin de grandes surfaces pour se déployer utilement et, d’ailleurs, l’attaque de front est une conception primitive et sommaire. Notre objectif ne doit pas être le front de l’ennemi, mais ses ailes. Le double enveloppement de l’armée romaine par Hannibal à Cannes demeure un chef-d’œuvre.

‘Nach Paris!’
An extraordinary excitement reigned in the bureau of the O.H.L (Oberste Heersleitung, Supreme Army Command). All armed services were leaving Koblenz and were to relocate to Luxembourg the following morning, 30th August. Everywhere, secretaries and orderlies were binding files together, hurried along by impatient and pompous officers. The official communiqué of 27th August had just caused a shockwave throughout Germany: ‘German armies in the west have penetrated into French territory, delivering continuous battle successes. From Cambrai to southern Vosges, the enemy has been extensively defeated and is in full retreat. It is not yet possible to estimate the scale of enemy losses in terms of those killed or taken prisoner, nor in terms of war spoils, due to the great extent of the battle fields, which consisted of partially covered, wooded and mountainous terrain.’
The 1st Army under General von Kluck had beaten the English at Mons on 23rd August. Against the French, von Bülow’s 2nd Army had taken victory the same day on the Sambre River in the Charleroi region; the 4th Army under the Duke of Wurttemberg had advanced in the Ardennes as the 5th Army, under the German Crown Prince, had done in Woëvre. On 20th and 21st August, the 6th Army under Crown Prince Ruprecht of Bavaria and von Heeringen’s 7th Army were victorious in Lorraine whilst the 1st Army had taken another victory over the English at Cateau, to the east of Cambrai, on August 26. On the 27th, General Helmuth von Moltke, Chief of the General Staff, submitted the general directives for the continuation of operations to the Emperor, Supreme Commander of the Armed Forces. The document ended with the words: ‘His majesty orders the German Army to march on Paris.’
The pompous, impatient officers of the O.H.L found the relocation to Luxembourg completely unsatisfactory, because they would need to advance further – by now much further – in order to follow the irresistible movement of the army, to be ultimately certain of propelling themselves to the front and rushing to join the victorious troops entering Paris.
Victory was beyond doubt and all the officers of the O.H.L, like every officer from every German Army, believed they deserved to take part in it. The sensational victory now within reach was neither the result of a fortunate piece of luck nor enemy incompetence. A French force of over one million men was in full retreat after only a few days of fighting because the German command had displayed an overwhelming superiority in all areas: discipline, troop instruction, deployment of arms, organisation of all services, as well as tactics and overall strategy. For many , the officer corps had worked persistently on forging the weapon of victory. And the great strategist who implemented the plan, the Prussian Junker von Schlieffen, monocled, rigid, unyielding, was an authentic representative of the elitist class – the term certainly did not displease those who were part of it – honoured as the elite of the German nation.
During times of peace the high command prepares for war; it’s their profession. After 1875, the evolution of European politics had led the German high command to foresee the eventuality of a war on two fronts. The old Feldmarschall Moltke, victor of 1870, had declared that in such an event it would be essential to take the fight to the Russian Army first, whilst remaining on the defensive on the French side. The series of fortifications around Thionville, Metz and Strasbourg, extended by the Rhine from Strasbourg to Bâle, were impassable. Once Russia is eliminated, attention would be turned towards France. Waldersee, Moltke’s successor (1838-1891), maintained this idea.
From the moment he arrived, von Schlieffen had declared Moltke’s plan outdated, un- implementable, incompatible with the necessities and capabilities of modern armies:
‘Russia’s railway network is pitiable. The Tsar’s General Staff will need six weeks to transport an army to our border and several months to undertake a large scale offensive. Yet we can crush France in less than two months. We must begin here, leaving a light covering force on the Russian front.
'It would be foolish to envisage military action against France merely as a violent thrust into the small region between the Franco-German border. Our large modern armies need great expanses of land in order to deploy effectively and, furthermore, frontal attack is a primitive and basic concept. Our objective should not be the front line of the enemy, but its flanks. The double envelopment of the Roman Army by Hannibal at Cannes remains a masterstroke. Outmanoeuvring the French Army on its two flanks is impossible for us for geographical reasons, but we can block off the French right flank in the fortified region and turn its left flank by passing through Belgium.’

En mai 2013, Piper-Heidsieck fête ses 20 ans de partenariat comme fournisseur avec le Festival de Cannes. Cet anniversaire est l’occasion de célébrer le lien privilégié qui unit la Maison bicentenaire au plus prestigieux des festivals de cinéma, et, plus largement, la relation intime de la Maison avec le Cinéma, depuis 80 ans.

Au cours de son histoire, la Maison Piper-Heidsieck a toujours les esprits les plus brillants. Dès sa création en 1785, le fondateur de la maison, Florens-Louis Heidsieck séduit la cour de Marie-Antoinette. Son audacieuse ambition de « créer une cuvée digne d’une Reine » devient alors réalité. En 1933, une bouteille de Piper-Heidsieck apparait dans «Les Compagnons de la Nouba», qui marque les débuts de Stan Laurel et Oliver Hardy. Dans les années 1950, ce ne sont pas les diamants mais l’or des vins Piper-Heidsieck qui séduit Marilyn Monroe, consacrant la Maison comme le champagne intime du cinéma. On n’oublie pas non plus ce Melchisedech (équivalent de 64 bouteilles, millésime 1959), la plus grande bouteille du monde, créée en 1964 à la taille de l’acteur anglais Rex Harrison (1,82 m) pour célébrer sa victoire aux Oscars dans « My Fair Lady ».
Une grande Maison de Champagne qui aime le cinéma et le cinéma le lui rend bien. De l’effervescence de la Croisette à celle d’une coupe de champagne, il n’y a qu’un pas symbolique. Sous le feu des projecteurs, le rouge de son étiquette et l’or de son vin sont devenus les symboles d’audace et de grandeur. Ils font écho officiellement aux moments forts de la quinzaine : de la montée inaugurale des marches habillées d’un tapis rouge, à la remise de la Palme d’or, en point d’orgue.

Throughout its history, the Piper-Heidsieck Maison has always possessed the brightest minds. From its very establishment in 1785, the Maison’s founder, Florens-Louis Heidsieck charmed the court of Marie-Antoinette. His audacious ambition to ‘create a vintage worthy of a Queen’ thus became a reality. In 1933, a Piper-Heidsieck bottle featured in ‘Sons of the Desert’, the debut film of Stan Laurel and Oliver Hardy. In the 1950s, it was not diamonds but the gold of Piper-Heidsieck’s wines which seduced Marilyn Monroe, thus ensuring its place as the most prestigious champagne of the film world. And let us not forget the Melchisedech bottle (equivalent to 64 bottles, 1959 vintage), the largest in the world, made in 1964 to measure the same height as British actor Rex Harrison (5ft 10”), in celebration of his victory at the Oscars for ‘My Fair Lady’.
This great Maison loves the cinema, and the cinema loves it back. From the effervescent glow of Boulevard de la Croisette to the scintillating sparkle of a glass of champagne, there is but a symbolic step. Under the spotlight, the red of the Piper-Heidsieck label and the gold of its wine have become symbols of audacity and grandeur. They are official representatives of the highlights of the Director’s Fortnight, from the inaugural climb of the red carpet stairs to the festival’s culmination: the awarding of the Palme d’Or.

Suite au scandale suédois d’août 1997 dévoilant les pratiques de stérilisation forcée, la France dut à son tour affronter son passé : en septembre 1997, la presse révéla que des femmes handicapées mentales furent stérilisées de force. L’étonnement fut grand d’autant plus que la France était relativement à l’abri de toute remise en question de sa politique de la reproduction, la seule mesure eugéniste à son passif étant le certificat prénuptial institué sous le régime de Vichy par la loi du 16 décembre 1942.
Le Japon vécut, à la même période, des réformes juridiques importantes, dont la réforme de la loi relative à la protection eugénique (Yûsei hogohô, 1948) en 1996. On modifia également le titre de la désormais « loi relative à la protection du corps maternel (Botai hogohô) », pour qu’il n’y ait pas de matière à contestation. Des plaintes furent par ailleurs déposées en juillet 1998 par des (anciens) malades de la lèpre, victimes des opérations de stérilisation forcée sous la loi relative à la prévention de la lèpre de 1953, abrogée en 1996. Le tribunal de district de Kumamoto leur donna gain de cause le 11 mai 2001 et condamna l’Etat à des dommages-intérêts.
Toutefois, la loi de 1948 fut réformée en un délai extrêmement court, soit en cinq jours durant lesquels elle fut débattue devant la chambre des Représentants et la chambre des Conseillers. Quant à la procédure judiciaire, l’Etat n’ayant pas fait appel, elle n’eut aucune suite. L’eugénisme fut ainsi très vite rayé de la carte juridique, la rapidité ayant pour conséquence un manque de débats publics, alors que la suppression des dispositions eugéniques constituait théoriquement une excellente opportunité de rétrospection.
Ce changement catégorique des années 1990 semble très révélateur d’un nouveau tournant de la politique de la reproduction au Japon. La décennie fut celle de la prise de conscience de la baisse de la fécondité, et d’un besoin d’affirmer une nouvelle politique de la reproduction décomplexée. La décennie fut également celle des réformes en termes d’égalité des sexes, une série de mesures étant lancée dès 1985, l’année de la ratification par le gouvernement japonais de la Convention internationale sur l’élimination de toutes les formes de discrimination à l’égard des femmes. Enfin, la décennie donna lieu à une remise en question du modèle familial dit « moderne », caractérisée par l’augmentation du célibat, des divorces, et des mariages tardifs.
La réforme de 1996 doit ainsi s’inscrire dans un cadre politique international et interne, sans oublier son cadre historique dont la linéarité est loin de faire l’unanimité. Dans quel(s) cadre(s) la suppression des dispositions eugénistes intervient-elle en 1996 ? Bien que cette réforme ne soit pas souvent analysée en termes de politique nataliste, il semble central d’englober cette approche pour analyser la portée de la politique de la reproduction d’aujourd’hui.
Dans le présent article, nous proposons une vue historique de la politique de la reproduction dont la visée est l’individu (I), complétée par une vue sur les cadres de la reproduction, soit le mariage et la famille (II). Dans les deux cas, l’enjeu de rallier droit et biologie semble en permanence se poser, avec pour défi de surmonter la loi de 1948 (III).
Translation - English Eugenics and Law – The Politics of Reproduction in Japan –
Following the Swedish scandal of August 1997 that uncovered practices of forced sterilisation, it was France’s turn to confront its past: in September 1997, the press revealed that mentally handicapped women had been subjected to forced sterilisation. This was all the more astonishing given that France’s politics of reproduction had barely been called into question, the only eugenic measure of its past being the prenuptial certificate instituted under the Vichy Regime by the law of 16 December 1942.
During the same period, Japan experienced important legal reforms, including the reform of the Eugenic Protection Law (Yûsei hogohô, 1948) in 1996. The name of the law was also changed to the “Maternal Body Protection Law (Botai hogohô)” so that it could not be contested. In June 1998, complaints were lodged by ex-sufferers of leprosy, victims of forced sterilisation operations under the Leprosy Prevention law of 1953, which was revoked in 1996. On 11 May 2001, the district tribunal of Kumamoto found in favour of the victims and ordered the state to pay damages.
However, the law of 1948 was reformed over an extremely short period of time – five days during which it was discussed in front of the House of Representatives and the House of Councillors. As the state did not make an appeal, no legal procedure followed. Eugenics was thus very quickly removed from the judicial map; the speed with which this took place caused a lack of public debate, yet the removal of the eugenic provisions theoretically made for an excellent opportunity for retrospection.
This categorical change during the 1990s appears largely revealing of a new turning point in the politics of reproduction in Japan. The decade was one of an awareness of the decline in fertility and of the need to maintain a new, uncomplicated politics of reproduction. It was also one of reforms in terms of sexual equality, with a series of measures introduced from 1985, the of the Japanese governments’ ratification of the International Convention on the Elimination of All Forms of Discrimination against Women. Finally, the decade gave rise to a re-assessment of the so-called “modern” family model and was characterised by an increase in single status, divorce, and delayed marriage.
Thus the 1996 reform must be placed within both an international and a domestic political framework, without forgetting its historical framework; the linearity of which is a long way from being agreed on completely. Within which framework(s) can the removal of the eugenic provisions in 1996 be placed? Although the reform is not often analysed in terms of a pro-natal policy, it seems that embracing this approach is central to analysing the impact of the politics of reproduction today.
In this article the politics of reproduction will be considered from a historical standpoint, with a focus on the individual (I), complete with an analysis of the reproductive context, namely marriage and the family (II). In each of the two cases, the issue of uniting law and biology seems to arise consistently, the challenge of which is to overcome the law of 1948 (III).
