Source text - Spanish El mundo a un click. La frase parece de cajón pero es la que mejor resume la transformación social, cultural y económica, e incluso política, que ha producido el internet en dos décadas. Ha sido la creación de un nuevo concepto del mundo, al borrar las fronteras terrestres que se crearon con los Estados y abrirle a la humanidad las puertas del conocimiento ilimitado.
Por eso las inquietudes que produce la llamada Ley Sopa -Stop Piracy Online Act- que se tramita en el Congreso de Estados Unidos y que pretende restringir la publicación de contenidos en la red bajo el pretexto de defender los derechos de autor y de la propiedad intelectual. En resumen, el proyecto reclama que las empresas de internet bloqueen los sitios que divulguen o vendan contenidos calificados como piratas por el FBI y se castigue a quien los utilice o baje de la red, aún por fuera de la nación norteamericana.
Las protestas en las que varios sitios on line ‘apagaron’ sus servicios por 24 horas y las voces en contra que se escuchan en diferentes puntos del planeta lograron que se suspendiera el estudio del proyecto que debía ser votado el próximo martes. La pregunta es si tal decisión implica cerrar el espacio que abrió el Internet. Y si ello significa restringir el dinamismo que portales como Wikipedia, buscadores como Yahoo o redes sociales como Facebook han dado a las comunicaciones y al diario vivir de la gente. ¿Cómo regular la distribución y el acceso a los contenidos, y cómo hacer que esa regulación se cumpla en todo el planeta?
Entre sus grandes revoluciones, el ciberespacio ha significado la transformación profunda de la propiedad intelectual. La industria musical, por ejemplo, desapareció tal como se conocía para dar paso a una forma que permite el acceso universal sin que en muchas ocasiones se deba pagar por ello. Otra muestra es Wikipedia, la enciclopedia virtual de más consulta por ofrecer conocimiento para todos, que se actualiza a partir de la información que suministran los mismos usuarios. Es oportuno pensar en la amenaza que implica ponerle límites.
El Tweet de Neelie Kroes, vicepresidenta de la Comisión Europea para las Telecomunicaciones, en alusión a la ley Sopa, puede resumir la posición de las mayorías: “El exceso de velocidad es ilegal, pero no pones baches en la autopista… no necesitamos mala legislación cuando deberíamos estar salvaguardando los beneficios de una red abierta”. El internet es una noria que parece imposible de parar. Cada día se registran 100.800 dominios, se montan 864.00 videos en Youtube y se envían 205.000 millones de correos, sólo para dar algunas cifras.
Sin duda se necesitan responsabilidad y leyes que protejan la propiedad intelectual. Pero ellas deben adaptarse al nuevo orden en las comunicaciones. Salvo lo que ocurre en Estados totalitarios como China o Cuba, el acceso a contenidos para quien los necesita es el gran aporte del Internet. Y si los Estados Unidos adopta la censura como estrategia para defender conceptos anticuados sobre los derechos de autor, se parecerá mucho a Cuba y a China.

The world is just a click away. The phrase seems cliché, but no other can sum up so effectively the social, cultural, economic and even political transformations that have been produced by the Internet in two decades. It has been the creation of a new understanding of the world, erasing the terrestrial borders created by states and opening the doors to unlimited awareness for humanity.
It is for this reason that the so-called SOPA law – Stop Online Piracy Act – has produced so many concerns. The law, currently being considered by the United States Congress, seeks to restrict the publication of online content under the pretext of defending authors’ rights and intellectual property. In sum, the act demands that Internet companies block those sites that make available or sell content classified by the FBI as pirated and seeks punishment of those who use or download this content, even if they do so outside of the North American country.
The protests, in which many sites “blacked-out” their services for 24 hours, along with the opposing voices heard in different parts of the world, led to the suspension of the bill’s consideration in Congress, which should have been voted on next Tuesday. The question is whether this decision would imply the closure of the space opened by the Internet, and if this would mean restricting the dynamism that portals like Wikipedia, search engines such as Yahoo and social networks like Facebook have given to people’s communication and daily life. How can the distribution of and access to content be regulated, and how can this regulation be enforced all over the planet?
Among its great revolutions, cyberspace has meant the profound transformation of the idea of intellectual property. For example, the music industry as it was known disappeared in order to make way for a form that allowed universal access, often without need for payment. Another example is Wikipedia, which, offering knowledge to all, has become the most consulted virtual encyclopedia. Its own users keep its information up to date. It is an opportune time to consider the threat implied by placing limits.
Neelie Kroes, European Commission Vice President for the Digital Agenda, summed up the majority position in her Tweets alluding to SOPA: “Speeding is illegal too: but you don't put speed bumps on the motorway.” Also: “don’t need bad legislation when should be safeguarding benefits of open net.” The Internet seems impossible to stop. Every day, 100,800 domains are registered, 864,000 videos are uploaded to YouTube and 205 billion emails are sent, to give just a few figures.
Responsibility is without a doubt necessary, as are laws to protect intellectual property, but they should be adapted to the new order of communication. Except in totalitarian states such as China or Cuba, access to content by those who need it is the Internet’s great contribution. If the United States adopts censorship as a strategy to defend antiquated concepts of authors’ rights, it will look a great deal like Cuba and China.

La Habana deberían reunirse constantemente con disidentes cubanos y defensores de los derechos humanos. No podemos cruzarnos de brazos y resignarnos ante una realidad como ésta. Nadie debe hacerse ilusiones sobre el carácter del gobierno cubano. No podemos romantizar ningún aspecto de este sistema cruel,
o justificar en modo alguno los abusos cometidos por Fidel Castro."

En los últimos tiempos, desde la enfermedad de Fidel Castro y la sucesión continuista de la revolución en manos de su hermano Raúl, prevalecen los análisis superficiales que, salvo honradas excepciones2, desconocen cuestiones fundamentales de la realidad cubana. Entre los pocos que han llegado a conocer la verdadera Cuba, viviendo allí varios años de la primera década del siglo xxi, están los dos diplomáticos que escriben en este libro.
El sueco Ingemar Cederberg, uno de los ganadores del Premio a la Diplomacia Comprometida en Cuba 2009-20103, comparte sus vivencias de cinco años cumpliendo funciones en la embajada de su país en La Habana, las cuales se complementan con el testimonio de un diplomático latinoamericano que se publica de manera anónima, como un fiel reflejo de lo que puede significar para un funcionario de carrera asumir una actitud humanitaria, aunque extremadamente discreta, frente a la complicidad con la dictadura cubana del gobierno que allí representó.
Además, se ofrece en versión resumida del capítulo “Cuba” del Manual del Diplomático, publicado por la Comunidad de las Democracias y cuya traducción del inglés fue realizada por Hernán Alberro, director de Programas del Centro para la Apertura y el Desarrollo de América Latina (cadal); una entrevista al pionero de la “diplomacia comprometida en Cuba”, el chileno Jorge Edwards, autor del best-seller Persona non grata; y los antecedentes históricos de la labor humanitaria de los diplomáticos, más allá de los límites de su función, a cargo de Pablo Brum y Mariana Dambolena.
Al final del libro se incorporan como Anexo las peticiones más relevantes impulsadas por el Proyecto Puente Democrático de cadal, desde 2004 hasta la actualidad.
Premio a la Diplomacia Comprometida en Cuba
Harald Edelstam, Allen “Tex” Harris4, Enrico Calamai, Dwight Fulford5, Johannes Marré, Elisabeth Demonte, James Cheek6 y Karl-Anders Wolter, son algunos de los nombres de diplomáticos extranjeros que se destacaron por su labor humanitaria durante las dictaduras militares en el Cono Sur.
Si bien los tres primeros casos son los más conocidos (el del sueco Edelstam en Chile, el del norteamericano Harris en Argentina y el del italiano Calamai en Chile y Argentina), la tarea de preservar la Memoria de lo sucedido durante los años de plomo en el Cono Sur, está sacando a la luz otros casos que son dignos de recordar.
Por tal motivo, la Memoria sobre las prácticas de diplomacia comprometida en ese trágico periodo en Argentina, Chile y Uruguay, obliga moralmente a sus gobiernos democráticos a implementar una política de Estado activa en sus relaciones exteriores en la defensa y la promoción internacional de los derechos humanos: “porque fuimos víctimas, no debemos olvidar a las actuales víctimas”7.
Obviamente, en América Latina la prioridad es la de promover la apertura política en Cuba, donde gobierna desde hace más de medio siglo un régimen de partido único cuya normativa legal expresamente convierte en delito a los derechos y libertades fundamentales8.
En el caso de la República Argentina se suma un hecho deliberadamente excluido de la Memoria, lo cual demuestra la utilización política que se hace de los derechos humanos pues Cuba fue un reconocido cómplice de la dictadura militar9 y, sin embargo, en lugar de recibir una fuerte condena, obtiene un complaciente apoyo10.
Precisamente, recordando la importancia que durante las dictaduras militares del Cono Sur tuvieron los gestos de solidaridad internacional, el Proyecto Puente Democrático de cadal surgió como una iniciativa de promoción internacional de los derechos humanos, empezando en la propia región por apoyar los esfuerzos de la oposición cívica no violenta en Cuba y tratando de incidir ante los gobiernos, organismos y organizaciones de la sociedad civil de América Latina11.
Una de las actividades más exitosas del Proyecto Puente Democrático ha sido la implementación del Premio a la Diplomacia Comprometida en Cuba, el cual ya fue otorgado en los periodos comprendidos entre 2003-200812 y 2009-201013. El premio destaca la labor de diplomáticos extranjeros acreditados en La Habana que hayan finalizado su misión, reconociendo a aquellos que se hayan caracterizado por brindar muestras de solidaridad hacia los demócratas en la isla y por realizar acciones comprometidas frente a las violaciones de los derechos humanos en ese país.
Para el otorgamiento del premio se ha consultado por teléfono y correo electrónico a la mayor cantidad posible de referentes democráticos en Cuba, seleccionando a los diplomáticos ganadores por la cantidad de votos recibidos y haber sido nominado por varios grupos. La entrega del premio, consistente en una plaqueta, queda condicionada a su aceptación por parte del diplomático premiado o su respectivo ministerio.
Al cumplirse el sexto aniversario de la ola represiva conocida como La Primavera Negra de Cuba, cadal entregó en Buenos Aires el Premio a la Diplomacia Comprometida en Cuba correspondiente al periodo 2003-2008. Los ganadores fueron: Daniel Gromann, ex encargado de Negocios de la Embajada de Polonia en La Habana; Stanislav Kázecky, ex primer secretario de la Embajada de la República Checa en La Habana; Michael Parmly, ex jefe de la Oficina de Intereses de Estados Unidos en La Habana; Melanie Hopkins, ex segunda secretaria de la Embajada Británica en La Habana; Hans-Ulrich Lunscken? (1952-2008), ex embajador de la República Federal de Alemania en Cuba; y Andrea Brouillette-Rodríguez, ex funcionaria del área de Derechos Humanos en la Oficina de Intereses de Estados Unidos en La Habana. Otros dos diplomáticos alemanes y uno noruego también fueron premiados.
En esta primera edición se consultaron a 135 personas, entre referentes de la oposición democrática en Cuba, familiares de presos de conciencia y diplomáticos extranjeros que aún permanecían en la isla. Todos ellos brindaron los nombres de los 48 diplomáticos extranjeros que consideraron merecedores de esta distinción. En cuanto a la procedencia de las votaciones, las mismas fueron realizadas desde los siguientes lugares y en las cantidades que figuran entre paréntesis: La Habana (56), Villa Clara (21), Pinar del Río (4), Exterior (3), Camagüey (3), Matanzas (3), Holguín (2), Guantánamo (2), Granma (1), Sancti Spiritus (1) y Cienfuegos (1). Por su parte, a continuación se ofrece el listado de los países cuyos diplomáticos fueron nominados, con la cantidad total de votos recibidos: Alemania (146), Polonia (123), Estados Unidos (102), Reino Unido (85), República Checa (60), Italia (36), Noruega (36), España (32), Francia (6), Unión Europea (6), Canadá (6), Países Bajos (6), Suecia (5), Japón (5), Suiza (2), Eslovaquia (2), Perú (2), Bélgica (1) y Portugal (1).
En la segunda edición de entrega del Premio a la Diplomacia Comprometida en Cuba correspondiente al periodo 2009-2010, los resultados fueron difundidos en el Día Internacional de los Derechos Humanos, el 10 de diciembre de 2010. En esta ocasión, la holandesa Caecilia Wijgers, el sueco Ingemar Cederberg y el alemán Volker Pellet fueron los diplomáticos extranjeros que más se destacaron por su labor humanitaria en Cuba.
En estos dos años fueron nominados al premio 16 diplomáticos extranjeros en Cuba, pertenecientes a los siguientes países: Holanda, Suecia, Alemania, España, Estados Unidos, Italia, Polonia, República Checa y Canadá. El otorgamiento de este premio contó nuevamente con 135 participantes, entre ellos Las Damas de Blanco, Oswaldo Payá, Yoani Sánchez, Vladimiro Roca, Elizardo Sánchez, René Gómez Manzano, Guillermo Fariñas, Dagoberto Valdés y Félix Bonne Carcasses. Asimismo, tuvo una representación geográfica que incluyó a La Habana, Camagüey, Guantánamo, Villa Clara, Sancti Spiritus, Holguín, Pinar del Río, Matanzas, Las Tunas, Cienfuegos y Santiago de Cuba.
Sobre la importancia de esta iniciativa, Elizardo Sánchez, destacado referente de la lucha pacífica por los derechos humanos en Cuba, expresó: “El régimen de los Castro también ejerce su enorme capacidad de intimidación sobre los diplomáticos y corresponsales extranjeros: la mayoría de los diplomáticos optan por ‘no buscarse líos’, y pasarla lo mejor posible. Esta realidad refuerza la necesidad y legitimidad del Premio a la Diplomacia Comprometida.”
Por su parte, el periodista independiente cubano, Frank Cosme Valdés Quintana, publicó un artículo en el Portal Primavera Digital, donde manifestaba que:
Fue una sorpresa grata enterarnos que los argentinos, luego de haber pasado por consecutivas dictaduras militares, fundaron cadal. Sólo los que han sufrido situaciones similares pueden comprender lo que sucede en otros países y ser solidarios, palabra que parece haber perdido su sentido en el medio diplomático acreditado en Cuba, salvo raras excepciones.
Estas raras excepciones fueron reconocidas por esta organización en un premio denominado “A la Diplomacia Comprometida en Cuba 2009-2010” y fueron otorgados a tres diplomáticos que se distinguieron por brindar apoyo a los demócratas cubanos, la holandesa Cecilia Wijgers, el sueco Ingemar Cederberg y el alemán Volker Pellet, quienes modestamente declararon que el premio no era sólo para ellos, sino para las embajadas que representan a sus respectivos países.
Más grato aún fue saber que los argentinos solicitaron a los distintos grupos contestatarios cubanos su opinión. Entre los consultados se encontraba la directiva de nuestra Primavera Digital y periodistas del mismo, así como representantes de amplios sectores de opinión, muchos ya internacionalmente conocidos.
Después de los tantos sinsabores que se pasan en esta desigual lucha por los derechos ciudadanos, en la que muchas veces representantes de gobiernos, personalidades religiosas, corresponsales, etc., olímpicamente ignoran a estas mujeres y hombres que escriben una hermosa página de nuestra historia, reconforta y recompensa con creces el reconocimiento de esta organización argentina a estos diplomáticos y a la vez a los cubanos que sólo desean un cambio pacífico14.
Precisamente, como el objetivo del premio es lograr el compromiso de los gobiernos democráticos frente a la situación de los derechos humanos en Cuba, empezando por brindar reconocimiento y protección a los disidentes políticos, se solicitó esta vez que los referentes de la oposición fundamenten en lo posible sus nominaciones.
Por ejemplo, Yoani Sánchez, del Blog Generación Y, ganadora de varios premios internacionales y una de las voces más influyentes del movimiento cívico cubano, destacó de la diplomática holandesa, Caecilia Wijgers, que: “Su dinamismo, laboriosidad y su afinidad con el temperamento cubano, fueron elementos importantes para que estrechara vínculos de trabajo y amistad con nuestra ciudadanía. Fomentó y apoyó de palabra y de obra, numerosos proyectos como la revista Convivencia, la blogósfera alternativa, el periodismo independiente y a la sociedad civil en general. Organizó numerosas conferencias e intercambios entre grupos disidentes que de otra manera no hubieran contado con un espacio de tolerancia donde reunirse.”
Respecto al diplomático sueco, Ingemar Cederberg, la bloguera expresó:
Se destacó por su implicación y apoyo a los grupos de la sociedad civil cubana. Impulsó durante su estancia en Cuba el diálogo con la oposición y con otros fenómenos de corte político, artístico e informativo. A él se le debe la apertura del centro de internet radicado en esa sede diplomática del que disfrutan semanalmente casi un centenar de personas. Llegó a ser un gran conocedor de la cultura del país, hombre de mucha sensibilidad para las artes y las letras. En su casa se celebraron eventos, reuniones, conmemoraciones y numerosos intercambios, justo en el momento en que muchos otros diplomáticos cerraban sus puertas a la sociedad civil y a la oposición.
Y finalmente, sobre el diplomático alemán Volker Pellet, la multipremiada activista en defensa de la libertad de expresión en Cuba, reconoció que: “Su estancia en Cuba coincidió con momentos de mucha tensión y de alta represión contra los grupos disidentes. Volker fue víctima también de una campaña de difamación oficial, su rostro y su nombre fueron difundidos en la televisión cubana acompañados de fuertes acusaciones. Acompañó en más de una peregrinación a las Damas de Blanco y fue un promotor incansable de nuevos fenómenos informativos y de expresión.”
Desde Pinar del Río, los integrantes del Proyecto Convivencia, entre ellos Dagoberto Valdés, nominaron a la diplomática holandesa:
Por su servicio al establecimiento de puentes entre los pueblos de los Países Bajos y Cuba. Por su entrega generosa, apasionada y coherente a la defensa de los derechos humanos y a la educación cívica de los cubanos y cubanas sin exclusión. Por sus contactos y relaciones respetuosas y sistemáticas con líderes de la sociedad civil cubana, con activistas de derechos humanos y otras personas comprometidas con el presente y futuro de Cuba. Por su sacrificado trabajo en el interior del país y su comprensión honesta y cabal de la situación de Cuba y la vida cotidiana de los cubanos y por el inmenso amor que ella y su familia entregaron personalmente a miles de personas sencillas e importantes en nuestro país. Cada obra de la sociedad civil en Cuba tiene la huella de su cercanía y solidaridad efectiva y discreta. Fue una consejera según la diplomacia de los nuevos tiempos en que los derechos humanos tienen la primacía sobre los intereses comerciales o ideológicos. Visitó nuestro proyecto en varias ocasiones y contribuyó significativamente a su desarrollo. Su sencillez y cordialidad le abrieron las puertas de los cubanos y cubanas y le cerraron otras que nunca pudieron comprender la autenticidad de su vida y de su trabajo. Su despedida de Cuba fue una fiesta de amistad y agradecimiento. Nunca la olvidaremos.
Asimismo, respecto al diplomático sueco, desde el grupo liderado por Dagoberto Valdés destacaron que:
Fue un interlocutor de los diferentes activistas de la sociedad civil cubana. Su cordialidad y atención puntual hicieron de él un diplomático bien informado y cercano a la Cuba real y a sus complejos problemas. Visitó cada año nuestro Proyecto y en cada ocasión escuchaba atentamente los diversos puntos de vista y análisis de la realidad cubana que le servirían para su labor diplomática. Escuchaba y preguntaba respetuosa e inteligentemente. Su aporte a la apertura de una sala de internet en la Embajada sueca fue una obra ingente de laboriosa paciencia y perseverancia.
Al final logró inaugurar “La Trastienda”, bautizada así por su ubicación y familiaridad por Yoani Sánchez y Reinaldo Escobar, destacados blogueros cubanos. Su sencillez y la de su inseparable y diligente esposa Mona Cederberg, le permitieron tender puentes de amistad con muchos cubanos y cubanas. Fue un diplomático comprometido con los pueblos de Suecia y Cuba, y no sólo con sus respectivas autoridades. Marcó durante años el estilo discreto y efectivo de la legación sueca en Cuba.
Elizardo Sánchez, de la influyente Comisión Cubana de Derechos Humanos y Reconciliación Nacional, señaló que:
Durante su estancia en Cuba, la señora Wijgers mantuvo una posición de verdadera solidaridad humana hacia el pueblo cubano y de apoyo moral a nuestros pacíficos esfuerzos para que la situación de derechos humanos mejorase en la isla. Siempre la recordaremos por su absoluta disposición a escucharnos con toda la paciencia del mundo y por su tenacidad para identificar formas concretas mediante las cuales pudiera manifestarse la solidaridad de su país y de otros países de Europa hacia nosotros. Llevo 43 años en la resistencia no violenta frente al régimen: nunca conocí a un diplomático(a) que se haya comprometido tanto con la causa de los derechos humanos y la democracia estando acreditado(a) en nuestro país, corriendo el riesgo de expulsión.
El jurista y activista de derechos humanos en Cuba, René Gómez Manzano, afirmó: “El Doctor Pellet se caracterizó por su solidaridad práctica con los disidentes pro democracia. No puede olvidarse que la propia televisión oficialista cubana lo presentó en diferentes ocasiones mientras hacía acto de presencia en los desfiles de las dignas Damas de Blanco.”
Eugenio Leal, del Grupo Veritas, destacó de la diplomática de los Países Bajos:
Su apoyo para el acceso a internet de los miembros del portal digital desdecuba.com y la revista Consenso y posteriormente Contodos, de las que soy miembro fundador, fue determinante para colocar los trabajos desde el interior del país. Ya que el estado cubano impide por medios electrónicos que se acceda a esos sitios y sólo es posible en una embajada. A todos se nos facilitó dos horas de acceso a internet un día fijo a la semana, en el local que habilitó para ese fin en esa embajada. Asimismo, siempre estuvo disponible para atendernos, y de forma respetuosa, ayudarnos. Nos estimuló y gestionó la aprobación de diferentes proyectos para desarrollar actividades y organizaciones de la emergente sociedad civil. Era habitual que cargara en su auto medios e insumos para entregarlo a periodistas independientes, bibliotecarios y otros promotores sociales en el interior del país.
A su vez, los diplomáticos que recibieron el Premio a la Diplomacia Comprometida en Cuba 2009-2010 expresaron su agradecimiento a los demócratas cubanos. Caecilia Wijgers, nacida en 1967 y actualmente desempeñándose como vicedirectora de la división política en la Organización de las Naciones Unidas (onu) del Ministerio holandés en La Haya, envió el siguiente mensaje:
Quisiera aprovechar esta oportunidad para expresar mi profundo agradecimiento a las personas dedicadas de cadal y de la iniciativa de Puente Democrático por el Premio a la Diplomacia Comprometida en Cuba 2009-2010. Les expreso desde mi alma que sinceramente es un gran honor para mí.
Quisiera agradecer especialmente por sus palabras gentiles a los miembros de la oposición cubana, activistas de derechos humanos, miembros de las familias de detenidos políticos y a los actores de la sociedad civil. En el trabajo durante mi estancia en Cuba siempre ha sido mi convicción que las libertades de expresión y del acceso a información son derechos básicos y fundamentales. Por eso para mí era obvio y natural apoyarlos en sus esfuerzos dirigido al bienestar del pueblo cubano.
Creo que una sociedad civil verdadera es un motor para crear espacio en que los ciudadanos puedan florecer y abrir puertas y ventanas. Estoy muy feliz porque he podido aportar algo aunque sea poco. Les deseo mucho éxito en sus esfuerzos ahora y en el futuro.
Volker Pellet, nacido en 1961 y cumpliendo actualmente funciones en Berlín como director de fundaciones políticas de la Cancillería alemana, agradeció el premio enviando el siguiente texto:
Me siento muy honrado de haber sido distinguido –junto a buenos colegas y amigos– con el Premio a la Diplomacia Comprometida en Cuba 2009-2010 de la prestigiosa organización cadal. Siento, humildemente, un poco de orgullo de que obviamente muchos de los disidentes en Cuba hayan valorado nuestro trabajo durante nuestro respectivo periodo en La Habana.
Sin embargo, los extranjeros y los diplomáticos son capaces sólo marginalmente de influir en la realidad de los disidentes y de la sociedad civil en Cuba. Pueden lograr pocas cosas, hacer pequeños gestos de solidaridad y apoyo humanitario, asegurar algún grado de atención internacional, pero no pueden mejorar considerablemente la situación de los derechos humanos. Esto sólo lo puede lograr la sociedad civil cubana que sigue viviendo bajo condiciones extremadamente difíciles.
Resulta verdaderamente una experiencia perdurable el haber compartido –por un periodo de tiempo relativamente breve– algunas de estas condiciones hasta cierto grado, haber mirado personalmente a los ojos de agentes de la Seguridad del Estado, haber sido expuesto en “actos de repudio” y haber sido testigo en varias ocasiones del trato injusto, intolerante e inhumano hacia grupos pacíficos como las Damas de Blanco.
Al mismo tiempo, esta experiencia personal fue indispensable para abrir los ojos a la realidad cubana que no me arrepiento de haber realizado.
Honestamente, espero que los diplomáticos venideros en La Habana den un paso al frente y vivan esta experiencia hasta que un día en un futuro, que espero no muy lejano, prevalezcan la tolerancia y el respeto por los derechos humanos en “el suelo más hermoso jamás visto por ojos humanos”.
Las relaciones internacionales y los derechos humanos
Para contextualizar el tema que se aborda en este libro, es necesario recordar que las dictaduras intentan ampararse en los argumentos obsoletos del “respeto a la soberanía” y “la no intromisión en los asuntos internos”, los cuales están limitados desde el 10 de diciembre de 1948, por el carácter universal expresado en la Declaración de los Derechos Humanos; reclaman “respeto e igualdad de trato”, a pesar de tener gobiernos que no han surgido de elecciones libres; y tratan de justificar su represión interna apelando a las “amenazas y los enemigos externos”, al mejor estilo orwelliano de 1984.
Entre las dictaduras remanentes, un caso emblemático es el del régimen cubano, que ya superó nada menos que ¡medio siglo en el poder! y donde una revolución armada surgida con el objetivo de recuperar la democracia se transformó en una dictadura desde sus primeros días en 1959, manteniendo hasta el momento un sistema político de partido y pensamiento único. Este régimen, que representa un claro límite a la consolidación de la democracia en América Latina, aprovecha la ventaja comparativa que tiene un gobierno de estas características en las relaciones internacionales.
Es que al disponer internamente de un sistema férreamente represivo, con medios de comunicación monopólicos y propagandísticos, su población vive con miedo y aislada del mundo; por lo cual la principal oposición y condena que recibe el régimen cubano proviene del exterior, a través de organizaciones de la sociedad civil, periodistas, intelectuales, algunos gobiernos y ocasionalmente organismos internacionales.
En consecuencia, la dictadura cubana dedica enormes recursos y actividades a su política exterior15, para obtener una legitimidad de la cual internamente carece desde la perspectiva del respeto a las libertades democráticas. Una evidencia obvia la ofrece el sitio web del Ministerio de Relaciones Exteriores de Cuba, informando que “tiene relaciones diplomáticas con 187 países. Dispone de 148 representaciones en el exterior en 121 países, de ellas, 120 embajadas, 1 sección de intereses, 20 consulados, 4 oficinas diplomáticas y 4 representaciones ante organismos internacionales”16.
Para hacer una simple comparación se puede tomar el caso de Argentina, con 30 millones más de habitantes a los 11 que viven en Cuba y con un Producto Interno Bruto Per Cápita (pib) superior al de los habitantes del paraíso castrista. De acuerdo a la información que se obtiene en el sitio web del Ministerio de Relaciones Exteriores, Comercio Internacional y Culto, la República Argentina mantiene relaciones diplomáticas con 191 países, pero dispone solamente de 79 embajadas.
En concreto, ¿cómo se entiende que un país menos desarrollado que Argentina y con un cuarto de sus habitantes, disponga de un tercio más de embajadas en el extranjero? A esto se suma la actividad del Instituto Cubano de Amistad con los Pueblos, entre otras formas de implementación de prácticas de “diplomacia paralela” donde el supuesto “desinterés” y la demagógica “solidaridad” son una suerte de “clientelismo político” global, comprando favores a cambio de becas a estudiantes extranjeros y enviando a médicos y maestros en “misiones internacionalistas”, para obtener en organismos internacionales los votos que no conseguirían internamente y legitimarse en el poder.
Por eso no ha extrañado que un régimen como el cubano, que implementa como política de Estado formas sistemáticas y obscenas para violar los derechos humanos, haya integrado desde su Constitución17 el Consejo de Derechos Humanos de la onu18 y posteriormente haya logrado su reelección por tres años más. Sobre esto último, la médica disidente cubana, Hilda Molina, se cuestionaba: “¿Cómo se explica que elijan para ese Consejo de Derechos Humanos a un gobierno que lleva 50 años sin moverse del poder y violando públicamente estos derechos? ¿Quiénes son los que eligen y reeligen para investigar, evaluar y juzgar la situación de los derechos humanos en el planeta, a un cincuentenario régimen dictatorial que ha institucionalizado la sistemática violación de derechos elementales?”19
El caso particular de Cuba demuestra que uno de los grandes desafíos que enfrenta la política exterior de los países democráticos es su relación con los regímenes dictatoriales, pues a la alternancia que se produce en el poder y a la lógica prioridad de los temas domésticos de sus gobiernos –pues es aquello que más importa a sus votantes–, se suma que en la política exterior prevalece el criterio del “interés nacional”. Este último puede estar asociado principalmente al comercio internacional, por lo cual la dictadura de China, como potencia económica, es realmente la principal amenaza actual a la globalización de los derechos humanos20. Pero también se tienen en cuenta los intercambios políticos, como en algunos casos, el de Argentina defendiendo a la dictadura cubana dado el apoyo brindado por el castrismo –en todas las épocas (incluida la invasión militar iniciada el 2 de abril de 1982) y en todos los foros internacionales– al reclamo argentino de la soberanía sobre las Islas Malvinas.
Pero más allá del realismo que se aplica a la política exterior, es un menoscabo a la Memoria que entre los objetivos estratégicos de la Cancillería de la República Argentina se destaque el de: “Priorizar la integración de la Argentina al mundo, mediante consensos orientados al fortalecimiento del derecho internacional, la promoción de los valores asociados a la paz internacional, la forma democrática de gobierno, el respeto a los derechos humanos…”21, manteniendo relaciones amigables con los dictadores e ignorando a activistas de derechos humanos que los padecen.
Por citar uno solo de tantos ejemplos22, considerando la actualidad al momento de escribir este texto, entre el 16 y el 22 de noviembre de 2008 la presidenta argentina, Cristina Fernández de Kirchner, realizó una gira oficial por los países de África del Norte23 que, más tarde, en los inicios del año 2011, ocuparían los principales titulares de las noticias internacionales por sus revueltas populares contra sus dictadores. Efectivamente, acompañada por una comitiva de empresarios, con una agenda dedicada solamente a los negocios y sin realizar ningún reclamo en materia de derechos humanos, Cristina Fernández se reunió gustosamente con el tunecino Zine Abidine Ben Ali, el egipcio Mohamed Hosni Mubarak y el mandatario de Argelia, Abdelaziz Buoteflika, aunque lo más sorprendente fue el encuentro con uno de los dictadores más siniestros del mundo, el libio Muammar Gadhafi. En su reunión con este último, la presidenta expresó lo siguiente: “Yo también, al igual que el líder de la nación libia, hemos sido militantes políticos desde muy jóvenes, hemos abrazado ideas y convicciones muy fuertes y con un sesgo fuertemente cuestionador al status quo que siempre se quiere imponer para que nada cambie y nada pueda transformarse.”24
Mientras tanto, aquello que no se aplica desde la Cancillería argentina ni despierta la sensibilidad en los organismos locales del establishment de los derechos humanos, lo promueve y recomienda como política pública en las relaciones exteriores el Proyecto Puente Democrático de cadal, con el objetivo de contribuir a la defensa global de las libertades civiles y políticas, mediante las siguientes actividades: a) brindar solidaridad internacional para apoyar los esfuerzos de apertura política de los demócratas que viven en países gobernados por dictaduras; b) incidir en la implementación de una política exterior comprometida con los derechos humanos por parte de los países democráticos; c) monitorear el Examen Periódico Universal en el Consejo de Derechos Humanos de la onu de los países gobernados por dictaduras; d) analizar la relación de la prensa y la política; e) alertar sobre las amenazas a la libertad de prensa en América Latina, y f) impulsar acciones conjuntas con organizaciones afines de la sociedad civil.
El Proyecto Puente Democrático de cadal propone que los gobiernos de países democráticos podrían empezar a contemplar una serie de medidas en materia de política exterior y de derechos humanos. En primer lugar, hacer público el voto en la elección de países miembros del Consejo de Derechos Humanos de la onu, incluyendo a sus autoridades, y difundir las recomendaciones realizadas al tratarse en dicho organismo el Examen Periódico Universal de países seriamente cuestionados por sus prácticas represivas.
En materia comercial, requerir la adhesión al Pacto Global en Responsabilidad Social Empresaria que impulsó Kofi Annan en 1999 a las empresas nacionales con intereses en países gobernados por dictaduras, lo cual debe ser un requisito para recibir apoyo de los organismos públicos que fomentan las exportaciones. Entre los principios del Pacto Global figuran, en primer lugar, los derechos humanos: “En su ámbito de influencia, las empresas deben: 1) apoyar y respetar la protección de los derechos humanos reconocidos internacionalmente, y 2) asegurarse de no ser cómplices de abusos de esos derechos.”
Por su parte, en las embajadas ubicadas en países gobernados por dictaduras, limitar la representación diplomática al rango de Encargado de Negocios. Esta medida simbólica implica una señal crítica en términos diplomáticos, por la situación interna de los derechos humanos en ese país.
En dichas sedes aplicar prácticas de diplomacia comprometida que brinden reconocimiento, protección y acceso a internet a los activistas de derechos humanos, incluyendo a periodistas independientes y familiares de presos políticos. Es que las relaciones de un estado democrático integran una muestra representativa de otras sociedades y no exclusivamente a los funcionarios gubernamentales; y, además, las prácticas de diplomacia comprometida deben ser una instrucción expresa para los funcionarios asignados en aquellos países donde la violación a los derechos humanos es la regla, en lugar de estar limitadas a excepcionales y heroicas muestras humanitarias.
Unos sólidos argumentos jurídicos para apuntalar el objetivo del Proyecto Puente Democrático de cadal, los ofrece el jurista Martín D. Farrell25:
[…] se ha producido un perceptible cambio de énfasis en el derecho internacional, y donde antes imperaba como principio supremo el de la soberanía de los estados, hoy le disputa esa jerarquía el interés por la protección internacional de los derechos humanos […]
[…] Parece plausible sostener que los derechos de los estados de acuerdo a los principios internacionales son derivaciones de derechos individuales: los estados no tienen ninguna base moral autónoma, ni son portadores de derechos internacionales que sean independientes de los derechos de los individuos que habitan el Estado. El Estado no es un ser moral, no es capaz de efectuar elecciones morales, ni de tener derechos estatales. Los gobiernos son simples agentes del pueblo, y sus derechos internacionales derivan de los derechos de los individuos que habitan –y constituyen– el Estado. El discurso acerca de los derechos de los estados se reduce al discurso acerca de los derechos individuales […]
[…] los individuos son los sujetos, tanto de la moral cuanto del derecho internacional, y su componente de imparcialidad la conduce al universalismo. Tiene también un componente de generalidad, en el sentido de que los individuos son los sujetos de preocupación para todos, y no solamente para sus compatriotas o correligionarios.
Farrell también brinda una afirmación que debería ser la norma de la política exterior en derechos humanos de los países democráticos: “debemos preocuparnos por los ciudadanos de los países extranjeros así como nos preocupamos por nuestros conciudadanos”, lo cual trae a la memoria la frase del disidente checo, Vaclav Havel: “Sé cuán importante es para una persona saber que allá afuera hay gente a la que no le es indiferente su destino.”26

In recent times, since the illness of Fidel Castro and the continuist succession of the revolution in the hands of his brother Raúl, superficial analyses have prevailed which, with honorable exceptions , fail to grasp fundamental questions of the Cuban reality. Among the few who have come to know the real Cuba, living there for several years in the first decade of the 21st century, are the two diplomats who have contributed writings to this book.
Ingemar Cederberg, one of the winners of the Prize for Committed Diplomacy in Cuba 2009-2010 , shares the experiences of his five years of service in the Swedish Embassy in Havana, complementing the testimony of a Latin American diplomat who is published anonymously, reflecting what it can mean for a career official to take a humanitarian stance, however discreet, against the complicity of his or her government with the Cuban dictatorship.
Also in this book, a summarized version of the chapter “Cuba” from the Diplomat’s Handbook published by the Community of Democracies, translated from English by Hernán Alberro, Director of Programs at the Center for the Opening and Development of Latin America (Cadal); an interview with the pioneer of “committed diplomacy” in Cuba, the Chilean Jorge Edwards, author of the best-seller Persona Non Grata; and a discussion of the historical precedents of humanitarian work by diplomats, beyond the limits of their professional duties, in the hands of Pablo Brum and Mariana Dambolena.
The book's appendices include the most relevant petitions championed by Cadal’s Democratic Bridge Project, between 2004 and this volume’s publication.
Prize for Committed Diplomacy in Cuba
Harald Edelstam, Allen “Tex” Harris , Enrico Calamai, Dwight Fulford , Johannes Marré, Elisabeth Demonte, James Cheek , and Karl-Anders Wolter are some of the foreign diplomats who stand out for their humanitarian labor during the military dictatorships in the Southern Cone. If the first three cases are the most well known (Swedish Edelstam in Chile, American Harris in Argentina, and Italian Calamai in Chile and Argentina), the task of preserving the memory of what happened during the “years of lead" in the Southern Cone is bringing to light other cases worth remembering.
The remembrance of committed diplomacy as practiced in Argentina, Chile and Uruguay during this tragic period morally obliges these countries’ current democratic governments to implement, in their foreign relations, an active state policy with regards to the international defense and promotion of human rights: “because we were victims, we must not forget the current victims” .
Obviously, in Latin America the priority is to promote political opening in Cuba, where a one-party regime, whose laws expressly convert fundamental rights and liberties into crimes, has governed for more than half a century .
In the case of Argentina, we find something that has been deliberately excluded from the remembrance of systematic human rights violations during the 1970s and 1980s: Cuba was an acknowledged accomplice of the military dictatorship in Argentina yet nevertheless, instead of receiving strong condemnation, it currently enjoys Argentina’s complacent support .
For this very reason, remembering the importance of gestures of international solidarity during the Southern Cone’s military dictatorships, Cadal’s Democratic Bridge Project came into being as an initiative for the international promotion of human rights, starting within its own region by supporting the efforts of the non-violent civil opposition in Cuba and seeking a voice in the decisions of governments, organizations, and civil society groups in Latin America .
One of the most successful activities of the Democratic Bridge Project has been the implementation of the Prize for Committed Diplomacy in Cuba, which has been awarded in the periods 2003-2008 and 2009-2010 . The prize highlights the work of accredited foreign diplomats in Havana that have finished their missions, recognizing those that were characterized by their gestures of solidarity to the island's democrats and their committed action in the face of human rights violations in Cuba.
The greatest possible number of democratic figures in Cuba was consulted by telephone and e-mail. The winning diplomats were selected based on the number of votes they received, as well as the number of distinct groups that nominated them. The actual awarding of the prize, a plaque, is conditional on the acceptance of the award by the diplomat or their respective ministry.
In Buenos Aires, on the sixth anniversary of the wave of repression known as the Black Spring of Cuba, Cadal awarded the Prize for Committed Diplomacy in Cuba corresponding to the period 2003-2008. The winners were: Daniel Gromann, former charge d’affaires of the Polish Embassy in Havana; Stanislav Kázecky, former first secretary of the Embassy of the Czech Republic in Havana; Michael Parmly, former head of the United States Interest Section in Havana; Melanie Hopkins, former second secretary of the British Embassy in Havana; Hans-Ulrich Lunscken† (1952-2008), former Ambassador of the Federal Republic of Germany in Cuba; and Andrea Brouillette-Rodríguez, former human rights official of the United States Interest Section in Havana. Two more German diplomats and one Norwegian also received the award.
For this first edition of the prize 135 people were consulted, among them figures from the democratic opposition within Cuba, families of political prisoners, and foreign diplomats that were still on the island. They offered the names of 48 foreign diplomats they considered worthy of this distinction. Following is a list of those areas from which votes were cast and, in parentheses, the number of votes from each location: Havana (56), Villa Clara (21), Pinar del Río (4), outside of the country (3), Camagüey (3), Matanzas (3), Holguín (2), Guantánamo (2), Granma (1), Sancti Spiritus (1), and Cienfuegos (1). Below, the list of countries whose diplomats were nominated, with the total number of votes received: Germany (146), Poland (123), United States (102), United Kingdom (85), Czech Republic (60), Italy (36), Norway (36), Spain (32), France (6), European Union (6), Canada (6), Netherlands (6), Sweden (5), Japan (5), Switzerland (2), Slovakia (2), Peru (2), Belgium (1), and Portugal (1).
In the second edition of the Prize for Committed Diplomacy in Cuba, corresponding to the period 2009-2010, the results were released to coincide with Human Rights Day, marked internationally on 10 December 2010. On this occasion, Caecilia Wijgers (Netherlands), Ingemar Cederberg (Sweden), and Volker Pellet (Germany) were the foreign diplomats who most stood out for their humanitarian labor in Cuba. During these two years, 16 foreign diplomats in Cuba were nominated for the prize, representing the following countries: Holland, Sweden, Germany, Spain, United States, Italy, Poland, Czech Republic, and Canada. Once again, 135 people participated in the voting, among them the Ladies in White, Oswaldo Payá, Yoani Sánchez, Vladimiro Roca, Elizardo Sánchez, René Gómez Manzano, Guillermo Fariñas, Dagoberto Valdés, and Félix Bonne Carcasses. Likewise, it had geographic representation that included Havana, Camagüey, Guantánamo, Villa Clara, Sancti Spiritus, Holguín, Pinar del Río, Matanzas, Las Tunas, Cienfuegos, and Santiago de Cuba.
Regarding the importance of this initiative, Elizardo Sánchez, a prominent figure in the peaceful struggle for human rights in Cuba, said: "[As well as against its own citizens, the] Castro regime exercises its enormous capacity for intimidation against foreign diplomats and correspondents: most diplomats opt to avoid trouble, and have the best time possible. This reality reinforces the necessity and legitimacy of the Prize for Committed Diplomacy.”
For his part, the Cuban freelance journalist Frank Cosme Valdés Quintana published an article in the portal Digital Spring, stating:
It was a pleasant surprise to discover that the Argentines, having passed through consecutive military dictatorships, had founded Cadal. Only those who have suffered through similar situations can comprehend what is happening in other countries and display solidarity, a word which seems to have lost its meaning in the circles of accredited diplomats in Cuba, but for rare exceptions.
These rare exceptions were recognized by this organization through their Prize for Committed Diplomacy in Cuba 2009-2010, awarded to three diplomats distinguished by the support they offered to Cuban democrats: the Dutch diplomat Cecilia Wijgers, Swedish Ingemar Cederberg, and German diplomat Volker Pellet. All modestly declared that the prize was not only for them, but also for the Embassies that represent their respective countries.
It was even more pleasant to discover that the Argentines had sought the opinion of different Cuban dissident groups. Among those consulted were the directors of our Digital Spring (Primavera Digital), and journalists of the same organization, along with representatives of wide sectors of opinion, many of them already well known internationally. After the many bitter moments in this unequal struggle for the rights of citizenship, in which government representatives, religious personalities, correspondents, etc. often heroically ignore those men and women who are writing a beautiful page in our history, we are comforted and more than compensated by the recognition offered by this Argentine organization to these diplomats and, at the same time, to the Cubans who seek nothing more than peaceful change .
As the objective of this prize is to encourage commitment from democratic governments in the face of the human rights situation in Cuba, beginning with the recognition and protection of political dissidents, opposition figures were asked to explain the reasoning behind their nominations as much as possible.
For example, Yoani Sánchez of the blog Generation Y, winner of several international prizes and one of the most influential voices of the Cuban civil movement, highlighted the qualities of the Dutch diplomat, Caecilia Wijgers: “Her dynamism, diligence, and affinity with the Cuban temperament were valuable, allowing her to develop close working ties, and friendships, with our citizens. She encouraged and supported, through word and deed, numerous projects such as the magazine Convivencia, the alternative blogosphere, independent journalism, and civil society in general. She organized numerous conferences and exchanges between dissident groups that otherwise would not have had a tolerant space in which to meet.”
The blogger also described the Swedish diplomat, Ingemar Cederberg:
He stood out for his engagement with and support of Cuban civil society groups. During his time in Cuba he drove dialogue with the opposition and other notable groups of a political, artistic, or informative nature. The opening of an Internet center in the diplomatic headquarters, enjoyed weekly by almost a hundred people, is thanks to him. He grew to be an expert in the country's culture, a man with great feeling for the arts and literature. Events, meetings, commemorations and numerous other exchanges were celebrated in his home, at a time during which many other diplomats were closing their doors to civil society and the political opposition.
And finally, regarding the German Volker Pellet, the activist (who has been awarded many prizes for her defense of freedom of expression in Cuba) stated that “[his] time in Cuba coincided with moments of much tension and high levels of repression against dissident groups. Volker, too, fell victim to a campaign of official defamation: his face and name were broadcast on Cuban television, accompanied by strong accusations. He joined the Ladies in White on more than one of their marches and was a tireless promoter of new initiatives of information and expression.”
In Pinar del Río members of Project Convivencia, among them Dagoberto Valdés, nominated the Dutch diplomat:
For her service in the establishment of ties between the peoples of the Netherlands and Cuba. For her generous, passionate, and coherent devotion to the defense of human rights and civil education for all Cuban people. For her contact and respectful, systematic relationships with leaders of Cuban civil society, human rights activists, and other people committed to Cuba’s present and future. For her selfless work in the interior of the country and honest, rigorous understanding of the situation in Cuba and the daily life of Cubans. And for the immense love she and her family demonstrated to thousands of people, both ordinary and important, in our country. Every project of civil society in Cuba bears the mark of her presence and effective, discreet solidarity. She was an advisor guided by the principles of a diplomacy of our times, in which human rights come before commercial or ideological interests. She visited our project many times and made significant contributions to its development. Her open, spontaneous nature and courtesy opened many Cuban doors to her, while closing those of the people who could never understand the authenticity of her life and her work. Her farewell from Cuba was a fiesta of friendship and gratitude. We will never forget her.
Likewise, the group headed by Dagoberto Valdés highlighted the work of the Swedish diplomat:
He served as an interlocutor for the different activists of Cuban civil society. His courtesy and prompt attention made him a well-informed diplomat with his finger on the pulse of the real Cuba and its complex problems. Each year he visited our project and listened attentively to the diverse points of view and analyses of the Cuban reality, which would serve him in his diplomatic work. He listened, and asked respectful, intelligent questions. His support for the opening of an Internet facility in the Swedish Embassy was a prodigious work of patience and perseverance. In the end he achieved the inauguration of the "Back Room" (Trastienda), so-named by Yoani Sánchez and Reinaldo Escobar (well-known Cuban bloggers) for its location and familiarity. His warm openness, and that of his inseparable and diligent wife Mona Cederberg, allowed him to build many friendships in Cuba. He was a diplomat committed to the Swedish and Cuban peoples, not simply their respective authorities. Over the course of years he established the discrete, effective style of the Swedish mission in Cuba.
Elizardo Sánchez of the influential Cuban Commission for Human Rights and National Reconciliation noted that:
During her stay in Cuba, señora Wijgers maintained a position of genuine human solidarity towards the Cuban people and of moral support for our peaceful efforts to improve the human rights situation on the island. We will always remember her for her constant willingness to listen to us, with all the patience in the world, and for her tenacity in finding concrete ways of demonstrating the solidarity of her country and other European countries with us. I have been practicing non-violent resistance against the regime for 43 years, and I never met a diplomat who was so committed to the cause of human rights and democracy while accredited in our country and running the risk of expulsion.
Cuban attorney and human rights activist, René Gómez Manzana, said “Doctor Pellet was characterized by his practical solidarity with pro-democracy dissidents. It cannot be forgotten that even Cuban official television broadcast him on different occasions as he marched with the honorable Ladies in White.” Eugenio Leal, of the Veritas Group, speaking of the Dutch diplomat, highlighted that:
Her support of Internet access for members of the digital portal desdecuba.com and the magazines Consenso and Contodos (I was a founding member of both) was a determining factor in the possibility of publishing works from inside the country. The Cuban government uses electronic means to prevent access to these sites and it is only possible in an embassy. She enabled all of us to use the Internet for two hours one set day each week, in the premises outfitted for this purpose in the Dutch embassy. Likewise, she was always available to receive us and offer respectful assistance. She encouraged us, and facilitated the approval of different projects to develop activities and organizations in the emerging civil society. She habitually loaded her car with supplies and newspapers, to be given to independent journalists, libraries and other promoters of civil society in the interior of the country.
For their part, the diplomats who received the Prize for Committed Diplomacy in Cuba 2009-2010 expressed their gratitude to the Cuban democrats. Caecilia Wijgers was born in 1967 and is currently working as Deputy Head of the Division of Political and Legal Affairs of the UN Department of the Dutch ministry in The Hague. She sent this message:
I would like to take advantage of this opportunity to express my profound gratitude to the dedicated people of Cadal and the Democratic Bridge Project for the Prize for Committed Diplomacy in Cuba 2009-2010. I express with deepest sincerity that this is a great honor for me.
I would especially like to thank, for their kind words, members of the Cuban opposition, human rights activists, family members of political prisoners, and other civil society actors. While working in Cuba, I always believed that freedoms of expression and of access to information are basic and fundamental rights. Because of this it was, for me, obvious and natural to support efforts devoted to the well being of the Cuban people.
I think a genuine civil society is a motor for the creation of space in which citizens can flourish, opening doors and windows. I’m very happy to have been able to contribute something, however small. I wish you all much success in your current and future efforts.
Volker Pellet, born in 1961 and currently working in Berlin as Director for Political Foundations in the German Foreign Ministry, expressed his thanks in the following message:
I feel very honored to have been awarded – together with good colleagues and friends – the Prize for Committed Diplomacy in Cuba 2009-2010 by the prestigious organization, Cadal. I feel a small, humble pride that many of the dissidents in Cuba have clearly valued our work during our respective periods in Havana.
Nevertheless, foreigners and diplomats are only marginally capable of influencing the reality of the dissidents and civil society in Cuba. They can achieve a few things, make small gestures of solidarity and humanitarian support, ensure some degree of international attention, but they can’t considerably improve the human rights situation. This can only be achieved by Cuban civil society, which continues to live in extremely difficult conditions.
It is a truly memorable experience to have shared – for a relatively brief period of time, and too a certain degree – some of these conditions: to have personally looked into the eyes of State Security agents, to have been exposed to "acts of repudiation", to have been witness on various occasions to unjust, intolerant, and inhumane treatment towards peaceful groups like the Ladies in White.
At the same time, this personal experience was indispensable. It opened my eyes to the Cuban reality and I don’t regret it. Honestly, I hope future diplomats in Havana take a step forward and live this experience until one day in the future, not very far away I hope, tolerance and respect for human rights prevail in “the most beautiful land ever seen by human eyes”.
International relations and human rights
To contextualize the theme of this book, it is necessary to remember that dictatorships try to shield themselves with the obsolete arguments of “respect for sovereignty” and “non-interference in internal matters”, both of which have been limited since 10 December 1948 by the universal language of the Declaration of Human Rights. Dictatorships demand “respect and equal treatment”, despite having governments that have not been freely elected, and they try to justify their internal repression by appeals to “external threats and enemies”, in true Orwellian style.
Among the remaining dictatorships, the Cuban regime is an emblematic case, having held onto power for nothing less than half a century. This regime grew out of an armed revolution that surged forth with the intention of reclaiming democracy, but that transformed into a dictatorship from its first days in 1959, maintaining until today a political system of one party and one thought. This regime, which represents a clear limit to the consolidation of democracy in Latin America, makes the most of the comparative advantage held by a government with these characteristics in international relations. This is because Cuba’s population lives isolated from the world and afraid, under a system of iron repression and monopolist, propagandist media, whereby the principal opposition and condemnation received by the regime come from outside, via civil society organizations, journalists, intellectuals, some governments, and occasionally international organizations.
In consequence, the Cuban dictatorship dedicates huge resources and activity to its foreign policy in order to obtain the legitimacy it lacks internally from the point of view of democratic liberties. An obvious piece of evidence can be found on the website of the Ministry of Foreign Affairs of Cuba, stating the country "has diplomatic or consular relations with 187 States. It has 148 diplomatic representations in 121 countries. At embassy level there are 120 representations, 1 Interests Section, 20 Consulates, 4 Diplomatic Offices, and also 4 permanent representations to International Organisms" .
To make a simple comparison one can take the case of Argentina, with 30 million more inhabitants than the 11 million that live in Cuba and with a gross domestic product (GDP) per capita greater than that of the Castro brothers’ paradise. According to the information found in the website of the Ministry of Foreign Affairs, International Trade and Worship, the Republic of Argentina maintains diplomatic relationships with 191 countries, but only has 79 embassies.
So, how can it be that a country less developed and with population one quarter the size possesses a third more overseas embassies than Argentina? To this is added the activity of the Cuban Institute of Friendship with the Peoples, among other forms of “parallel diplomacy” where apparent “unselfishness” and demagogic “solidarity” are a kind of global “political clientelism”, buying favors with scholarships for foreign students and sending doctors and teachers on “internationalist missions”. All this, to obtain in international organizations the votes they would not receive internally, thus legitimizing themselves in power.
Whereby it is no surprise that a regime like that in Cuba, which implements systematic and obscene violations of human rights as state policy, has formed part of the UN’s Human Rights Council since that body’s creation . It later managed to be re-elected for three more years. On this point, the Cuban dissident doctor, Hilda Molina, asks herself: “How do you explain the election to the Human Rights Council of a government has spent its 50 years in power publically violating those same rights? Who are they, that elect and reelect a 50-year-old dictatorial regime that has institutionalized the systematic violation of basic rights to carry out the investigation, evaluation, and judgment of the planet's human rights situation?”
The case of Cuba shows that one of the great foreign policy challenges for democratic countries is their relationship with dictatorial regimes. Alternation of power and the logical priority of domestic themes – those that matter most to their voters – are further complicated by the prevalence of “national interest” in foreign policy. This last can principally be associated with international trade, and it is for this reason that the Chinese dictatorship, now an economic power, is the principal current menace to the globalization of human rights. But exchanges of a political nature also bear keeping in mind, such as the defense of the Cuban dictatorship by Argentina in return for the support offered by the Castro regime to the Argentine claim to sovereignty over the Falkland Islands (Islas Malvinas) at all times – including during the military invasion initiated April 2, 1982 – and in all international forums.
But beyond realism in foreign policy, it undermines the remembrance of our own dictatorships that among the strategic objectives of the Argentine Foreign Ministry is found: “To prioritize the integration of Argentina in the world, through consensuses oriented at the strengthening of international law, the promotion of values associated with international peace, democratic government, respect for human rights…” , while the same ministry maintains friendly relations with dictators and ignores the human rights activists suffering under them.
To cite just one of many examples , taking one that is highly relevant at the time of publication: between 16 and 22 November, 2008 the Argentine president, Cristina Fernández de Kirchner, made an official tour of those countries of North Africa that later, at the start of 2011, would occupy international news headlines due to the popular revolts against their dictators. She was accompanied by a delegation of entrepreneurs, with an agenda dedicated solely to business and without realizing a single demand regarding human rights.
Cristina Fernández gladly met with Tunisian Zine Abidine Ben Ali, Egyptian Mohamed Hosni Mubarak and the Algerian leader Abdelaziz Buoteflika, although the most surprising was her meeting with one of the most sinister dictators in the world, Libya's Muammar Gadhafi. In her meeting with Gadhafi, the president expressed that: "The leader of the Libyan nation and I have both been political activists from a very young age, have embraced very strong ideas and convictions, and share a point of view that strongly questions that status quo which is imposed in order to prevent change or the possibility of transformation.”
Meanwhile, Cadal's Democratic Bridge Project promotes and recommends as public policy in foreign relations precisely that which is not applied by the Argentina’s Foreign Ministry and does not inspire action on the part of local organizations of the human rights establishment. Its objective is contribute to the international defense of civil and political liberties, through the following activities: a) offer international solidarity to support the efforts towards political opening of those democrats that live in countries governed by dictators; b) to have a bearing on the implementation by democratic countries of foreign policies based on human rights; c) to monitor the Human Rights Council’s Universal Periodic Review, concentrating on those countries governed by dictatorships; d) to analyze the relationship between politics and the press; e) to flag threats to the liberty of the press in Latin America, and f) to drive action, together with kindred civil society organizations. Cadal’s Democratic Bridge project proposes that the governments of democratic countries could begin to contemplate a series of measures in the areas of foreign policy and human rights. First, to publicize the votes cast in the election of member countries to the UN's Human Rights Council, including its authorities, and to make available the recommendations made during the preparation of said organization’s Universal Periodic Review regarding countries seriously questioned for repressive acts.
In terms of trade, to require that national corporations with interests in countries governed by dictatorships adhere to the Global Compact in Corporate Social Responsibility initiated by Kofi Annan in 1999. This should be a requirement in order to receive support from export-oriented public bodies. Human rights take first place among the principles of the Global Compact: “Within their sphere of influence … businesses should: 1) support and respect the protection of internationally recognized human rights; and 2) make sure that they are not complicit in human rights abuses.”
For their part, embassies located in countries governed by dictatorships should limit their diplomatic representation to the rank of charge d’affaires, a symbolic measure that implies criticism of the internal human rights situation in that country. In said headquarters, practices of committed diplomacy should be applied, offering recognition, protection and Internet access to human rights activists including independent journalists and the families of political prisoners. Diplomatic relationships of a democratic state entail a representation of their societies and not just their governments. Further, the practice of committed diplomacy, instead of being limited to exceptional and heroic humanitarian acts, should be expressly taught to those officials assigned to countries where the violation of human rights is the norm.
The jurist Martín D. Farrell offers solid juridical arguments that support the objectives of Cadal’s Democratic Bridge project :
[…] a perceptible change has been produced in international law, and where previously the supreme principle of the sovereignty of states was imperative, today its position in the hierarchy is disputed by interest in the international protection of human rights […]
[…] It seems plausible to sustain that the rights of states in accordance with international principles are derived from individual rights: states have no autonomous moral base, nor are they the bearers of international rights independent of the rights of those individuals that inhabit the state. The state is not a moral being, and is not capable of affecting moral choices or of possessing state rights. Governments are mere agents of the people and their international rights derive from the individual rights of the individuals that populate – and constitute – the state. The discourse on the rights of states is reduced to the discourse on individual rights [...]
[…] individuals are the subjects, as much in moral reasoning as in international law, and the component of impartiality extends this morality to universality. It also has a component of generality, in the sense that individuals are the subjects of concern for all, and not just their compatriots or coreligionists.
Farrell also offers an affirmation that should be the norm in democratic countries’ foreign policy with regard to human rights: “we should concern ourselves for the citizens of foreign countries as much as we concern ourselves for our own citizens”, which brings to mind a phrase of the Czech dissident, Vaclav Havel: “I know how important it is for a person to know that out there, there are people who care about your destiny.”
