Thank you. It is all much clearer now. I like "state or persecution". But perfer persecutory power. Is anyone going to post this?

A search through Google shows me that it is used quite frequently often by analogy simply to mean persecution usually by the state. I have read that the desire to prosecute taxi-drivers in Italy for some demeanour or other can be likened to Stalin's persecution of the Kulaks or a law of 1955 which gives a pension to anti-fascist who had suffered the vis persecutoria of the fascists. I would translate active persecution or perhaps "state persecution" of Christians in various countries today.

'Vis' can also mean 'power', so something like "Recognition of the status presupposes that the applicant is subject to (or the subject of) a persecutory power..." is another possibility.

Would this not be the same as saying "persecutory action"? I do feel though that the adjective ought to be something stronger that implies physical/mental aggravation or violence, i.e. a synonym of "active" that suggests something a bit more forceful.

This is a campaign of persecution by the Chinese authorities. Something more generic would be "active persecution". The word "effort" to me right now conjures up failure. England played well and made great efforts but.... Argghhh!!! I think they mean effective persecution not attempts at it.

I have used "persecutory effort". This paragraph is referring to refugee law in general, although the actual case regards a Chinese asylum seeker in the context of the religious practising Chinese population who are persecuted by the Communist rule in China.

I said the meaning is "fairly clear", but the more I think about it the less it is. Is this about physical violence in the sense of lock them up and abusing them physically? Or about children getting bullied and beaten on a regular basis? Just a pointer I'm afraid, unless you can give clearer context of actual cases.

"vis" is Latin for violence and used quite a lot in Italian law, so the meaning seems fairly clear, harassment with violence, but I'm really guessing. I mean harassment is usually verbal stuff, while this might be physical bullying, or maybe the vis includes mental violence.
