Source text - English Following the 12 January 2010 earthquake in Haiti, several national sections raised the question of international adoptions of child quake victims. Indeed, as underlined by the IMS / IRC, the risk of illegal adoptions and trafficking of children increases sharply in a situation of war or post-natural disaster. In its statement, DCI-France stresses the importance of “the rule of law in the best interests of Haitian children”. Too often children are classified as orphans when they were in fact only temporarily separated from their families.
Hasty conclusions made in the heat of great emotion can lead to a dangerous and uncontrollable situation of child trafficking. DCI-Argentina therefore strongly discourages the temporary evacuation of children. DCI-France also states that any child victim should be moved only if his or her identity and parentage have been established and only if a judicial authority legally entrusts the child to an approved host organization.
For that, DCI-France calls on:
• Haitian authorities to quickly organise the reunion of lone children with members of their families;
• Airline pilot unions and shipping companies to not take onboard children who do not have the documents required by the International Convention of the Hague of 1993;
• Journalists to transmit this warning to the world; and
• Parents wishing to adopt to not let themselves be abused by associations offering the quick adoption of a Haitian child.
DCI-Argentina and DCI-France both stress the importance of rebuilding the future of Haitian children in their own country before considering any international adoption. The rule of law in the best interests of Haitian children must absolutely take priority over emotions caused by this dramatic event.
Translation - French Après le tremblement de terre qui a secoué Haïti le 12 janvier 2010, de nombreuses sections nationales ont tiré la sonnette d’alarme au sujet des adoptions à l’étranger des enfants victimes du séisme. En effet, comme l’ont souligné l’IMS et l’IRC, le risque d’adoption illégale et de trafic d’enfants augmente considérablement en situation de guerre ou de post-catastrophe naturelle. Dans son communiqué, DEI-France met l’accent sur l’importance de « privilégier le respect du droit dans l’intérêt supérieur des enfants haïtiens ». Il arrive trop souvent que des enfants soient considérés comme orphelins, alors qu’en réalité ils ne sont séparés de leur famille que momentanément.
Les conclusions hâtives auxquelles on peut en venir sous le coup d’une forte émotion peuvent mener à une situation de trafic d’enfants dangereuse et incontrôlable. En conséquence DEI-Argentine s’oppose fortement à l’évacuation temporaire des enfants. DEI-France déclare aussi que tout enfant victime du séisme ne peut être déplacé que si son identité et sa filiation ont été établies, et seulement si une autorité judiciaire le confie légalement à une organisation d’accueil agréée.
Pour cela, DEI-France demande
• Aux autorités haïtiennes d’organiser rapidement le rapprochement d’enfants trouvés seuls avec les membres de leur famille ;
• Aux syndicats de pilotes de ligne et aux compagnies maritimes de ne pas permettre l’embarquement d’enfants qui ne disposent pas des documents requis par la Convention Internationale de la Hague de 1993 ;
• Aux journalistes de diffuser largement cet avertissement; et
• Aux parents désireux d’adopter de ne pas se laisser abuser par des associations qui proposent l’adoption rapide d’un enfant haïtien.
DEI-Argentine et DEI-France soulignent toutes deux combien il est important de reconstruire le futur des enfants haïtiens dans leur propre pays avant de considérer une adoption à l’étranger. Le respect du droit dans l’intérêt supérieur des enfants haïtiens doit à tout prix l’emporter sur les émotions causées par cet événement tragique.
