Anyway, here is the explanation: "comparire dinanzi all'intestato Tribunale Civile di Roma, nella sua nota sede di V.le G. Cesare in Roma, all'udienza del 30 maggio 2002, ore di rito, dinanzi al Giudice designando ex art.168-bis c.p.c.," http://www.prignano.it/citazione.htm Art. 168 bis c.p.c. (Designazione del giudice istruttore): Formato un fascicolo d’ufficio ... il cancelliere lo presenta senza indugio al presidente del tribunale, il quale, con decreto scritto in calce alla nota d’iscrizione a ruolo, designa il giudice istruttore davanti al quale le parti devono comparire … Subito dopo la designazione del giudice istruttore il cancelliere iscrive la causa sul ruolo ... del giudice istruttore e gli trasmette il fascicolo . Dunque, designato in conformita a quanto disposto dal art.168.... investigating magistrate to be designated Explanation: Under civil law it is in fact the investigating judge; he is designated at an earlier phase than in common law (i.e. when the 'procuratore', who is not strictly the prosecutor but represents the public interest and has an invocatory role, refers a case to the magistracy), and the police investigates under the instructions of the giudice istruttore. -------------------------------------------------- Note added at 2 days 4 hrs 35 mins (2003-08-03 07:04:08 GMT) Post-grading -------------------------------------------------- Sorry - meant \'examining magistrate\", not \'investigating\'. |
