Estoy traduciendo un texto en el que se cita un fallo de un tribunal inglés del año 1864. Comienza de la siguiente manera:

To a declaration for not accepting Surat cotton which the defendant bought of the plaintiff "to arrive ex Peerless from Bombay," the defendant pleaded that he meant a ship called the "Peerless" which sailed from Bombay, in October, and the plaintiff was not ready to deliver any cotton which arrived by that ship, but only cotton which arrived by another ship called the "Peerless," which sailed from Bombay in December.
Held, on demurrer, that the plea was a good answer.

Entiendo lo que significa la frase, pero me está costando traducirla porque no logro encontrarle a vuelta a “on demurrer”.

demurrer" is a pleading stating that although the facts alleged in a complaint may be true, they are insufficient for the plaintiff to state a claim for relief and for the defendant to frame an answer. In most jurisdictions, such a pleading is now termed a motion to dismiss, but the demurrer is still used in a few states, including California, Nebraska, and Pennsylvania."

Aunque algunos diccionarios presentan el término "excepción perentoria", por la definición que he encontrado me parece que no se ajusta exactamente al término inglés. Ver por ejemplo:

Son de dos clases:
1. Excepciones previas o dilatorias y
2. Excepciones perentorias.
Ambas se rigen por las normas del Proceso Ordinario De Puro Derecho. Deberán ser opuestas en 5 días si es excepción previa y 15 días si es excepción perentoria.
