They ( the Parties) explicitly acknowledged that and were formally identified Explanation: "عرفوا قدره شُهِدَ به عليهم وهم بأتمه وعرَّف بهم بما ذُكِرَ صَدْرَه" أي: إن المتعاقدين (الزوج والزوجة والولي) عرفوا تمام المعرفة قدر الأمر الذي تعاقدوا عليه وهو الزواج، وأن العدلين المحررين قد شهدوا عليهم بأنهم عقدوا عقد زواج وأن الفريقين أصبحا زوجين وأن الفريقين راشدان يعيان ماذا يعني أن يصبحا زوجين. و"هم بأتمه" أي تم التعريف بهوية المتعاقدين على التمام والكمال بناء على بطاقة الهوية وعقد الولادة والشهادة الإدارية الخ. "وعرَّف بهم بما ذكر صدره" أي أن العدل (العدل الأول الذي تحفظ الشهادة في مذكرة حفظه أو كناش جيبه) قد عرَّف بالمتعاقدين المعرفة الواجبة شرعاً في صدر العقد أي في أوله www.alfaseeh.com/vb/archive/index.php/t-15453.html. |
